Abstract
The community of Catalina Gading Serpong is experiencing a clean water crisis due to water pollution and the construction of the Cartensz Gading Serpong apartment mall. The identification of the problem, how is the legal protection of the Catalina Sector community experiencing a clean water crisis due to the construction of the Cartensz Gading Serpong apartment mall in a residential area based on Government Regulation Number 22 of 2021 concerning PPLH? and how is the implementation of the granting of permits for the construction of the Cartensz Gading Serpong apartment mall in a residential area based on Government Regulation Number 22 of 2021 concerning PPLH? The theories used are legal protection theory and government action theory. The research method is empirical juridical. The research specification is descriptive analysis. The data source is primary data supported by secondary data. Data collection techniques are interviews and documents related to the research. Data obtained and analysed descriptively with a qualitative approach method. The results of the research of the Catalina Sector community in Gading Serpong have not legal certainty and legal protection in accordance with Article 157 of Government Regulation Number 22 of 2021 concerning PPPLH related to the impact of the clean water crisis due to the construction of the Cartensz Gading Serpong apartment mall. This is because there has been no government action in providing legal protection. The granting of the Cartensz Gading Serpong apartment mall permit is not in accordance with the development plan of the Catalina Sector developer Gading Serpong and the objectives of the Tangerang Regency RTRW. There was no community involvement in the granting of the development permit EIA. This is due to legal violations committed by the local government of Tangerang Regency and the Head of RT/RW of Catalina Sector Gading Serpong. Suggestions, the T angerang Regency Government in providing legal protection conducts supervision, evaluation, and action on the granting of development permits.

Pemerintah Daerah bertanggung jawab memberikan perlindungan hukum di daerah berdasarkan Peraturan Pemerintah Nomor 22 Tahun 2021 tentang PPPLH. Identifikasi masalahnya, bagaimana perlindungan hukum terhadap masyarakat Sektor Catalina yang mengalami krisis air bersih akibat pembangunan mall apartemen Cartensz Gad ing Serpong d ikawasan permukiman berd asarkan Peraturan Pemerintah Nomor 22 Tahun 2021 tentang PPPLH? dan bagaimana implementasi dari pemberian izin pembangunan mall apartemen Cartensz Gading Serpong dikawasan permukiman berdasarkan Peraturan Pemerintah Nomor 22 Tahun 2021 tentang PPPLH? Teori yang digunakan yaitu teori perlindungan hukum dan teori tindakan pemerintah. Metode penelitian yaitu yuridis empiris. Spesifikasi penelitian yaitu deskriptif analisis. Sumber data yaitu data primer yang ditunjang oleh data sekunder. Teknik pengumpulan data adalah wawancara dan dokumen yang terkait dengan penelitian. Data diperoleh dan analisis secara deskriptif dengan metode pendekatan kualitatif. Hasil penelitian masyarakat Sektor Catalina Gading Serpong tidak mendapatkan kepastian hukum dan perlindungan hukum sesuai dengan Pasal 157 Peraturan Pemerintah Nomor 22 Tahun 2021 tentang PPPLH terkait dampak krisis air bersih akibat pembangunan mall apartemen Cartensz Gading Serpong. Hal tersebut karena tidak adanya tindakan pemerintah dalam pemberian perlindungan hukum. Pemberian izin mall apartemen Cartensz Gading serpong tidak sesuai dengan rencana pembangunan pengembang Sektor Catalina Gading Serpong dan tujuan RTRW Kabupaten Tangerang. Tidak ada keterlibatan masyarakat dalam pemberian Amdal izin pembangunan. Hal tersebut dikarenakan ad anya pelanggaran hukum yang d ilakukan pemerintah d aerah Kabupaten Tangerang dan Ketua RT/RW Sektor Catalina Gading Serpong. Saran, Pemerintah Kabupaten Tangerang d alam pemberian perlind ungan hukum melakukan pengawasan, evaluasi, dan tindakan terhadap pemberian izin pembangunan. | |||||||||
