Abstract

Indonesia is one of the countries that channelled many of its citizens abroad to become Indonesian Migrant Workers (PMI). However, there are problems experienced by migrant workers, such as violence from employers. As experienced by Adelina Lisao, a migrant worker who died a day after being found in her employer's house in Malaysia in 2018. The problems in this research are as follows: First, What is the Form of Legal Protection to Indonesian Migrant Workers in Review of the International Convention On The Protection Of The Rights Of All Migrant Workers And Members Of Their Families 1990? and second, Can the International Convention On The Protection Of The Rights Of All Migrant Workers And Members Of Their Families 1990 Be Applied Effectively in the Case of Indonesian Migrant Worker Adelina Lisao in Malaysia?. The theories used are Legal Protection Theory, Justice Theory, and Welfare Theory. The method used is Normative Juridical with descriptive analytical research specifications and data collection techniques using literature study. The results of this study are first, the form of legal protection of the rights obtained by migrant workers is legal protection, should not be subjected to torture, should not be enslaved and so forth. Second, the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families 1990 is not applied effectively in the case of Indonesian Migrant Worker Adelina Lisao in Malaysia because Indonesia as a ratifying country does not implement the provisions in article 66 and Malaysia which did not ratify the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families 1990.

Namun, terdapat masalah yang dialami oleh PMI, misal kekerasan dari majikan. Seperti yang dialami oleh Adelina Lisao, seorang PMI yang Meninggal sehari setelah ditemukan di rumah majikannya di Malaysia pada tahun 2018. Adapun masalah dalam penelitian ini adalah sebagai berikut: pertama, Bagaimana Bentuk Perlindungan Hukum Kepada Pekerja Migran Indonesia Ditinjau Dari International Convention On The Protection Of The Rights Of All Migrant Workers And Member Of Their Families 1990? dan kedua, Apakah International Convention On The Protection Of The Rights Of All Migrant Workers And Member Of Their Families 1990 Dapat Diterapkan Secara Efektif Pada Kasus Pekerja Migran Indonesia Adelina Lisao Di Malaysia?. Teori yang digunakan adalah Teori Perlindungan Hukum, Teori Keadilan, dan Teori Kesejahteraan. Metode yang digunakan adalah Yuridis Normatif dengan spesifikasi penelitian deskriptif analitis dan teknik pengumpulan data menggunakan studi kepustakaan. Hasil dari penelitian ini adalah pertama, Bentuk Perlindungan Hukum perlindungan hak-hak yang diperoleh oleh Pekerja Migran adalah perlindungan hukum, tidak boleh dijadikan sasaran penyiksaan, tidak boleh diperbudak dan lain sebagainya. Kedua, International Convention on the Protection of the Rights of All Migrant Worker and Members of Their Families 1990 tidak diterapkan secara Efektif Pada Kasus Pekerja Migran Indonesia Adelina Lisao Di Malaysia karena Indonesia sebagai negara peratifikasi tidak melaksanakan ketentuan pada pasal 66 dan Malaysia yang tidak meratifikasi International Convention on the Protection of the Rights of All Migrant Worker and Members of Their Families 1990.
