Abstract

The Covid-19 pandemic has caused losses in various sectors of life. The most visible losses are in public health, the economy and in other sectors. The most obvious example is in the economic sector. Because many companies are forced to reduce their workforce, as experienced by PT Alloy Mandiri Food workers who were unilaterally laid off/laid off by the company without prior discussion with the workers' union or worker representatives. This research will raise issues in the field of civil law, especially in the field of employment. The main issues that will be discussed are whether it is justified to lay off workers due to the Covid-19 pandemic and what was the basis for the judge's consideration in the decision of PHI PN Serang No. 20/Pdt.SUS-PHI/2021 rejected the lawsuit from the plaintiffs (PT Alloy Mandiri Food workers) in accordance with Law Number 13 of 2003 concerning Employment. Labor law regulates the relationship between workers and employers solely to provide certain boundaries and protect workers as parties who are weaker than employers so that their rights are guaranteed and vice versa, which then gave rise to the concept of legal protection. The existence of rules and implementation of legislation creates legal certainty. The research method used in this research is normative juridical to find the truth of coherence, whether there are legal rules in accordance with legal norms and whether there are norms in the form of orders or prohibitions that are in accordance with legal principles. The housing/laying off of workers is regulated in the Circular Letter of the Minister of Manpower Number: SE-907/MEN/PHI-PPHI/X/2004 concerning Prevention of Mass Termination of Employment and in the Circular Letter of the Minister of Manpower Number M/3/HK.04/III /2020 concerning worker protection for workers and business continuity in the context of preventing and controlling Covid-19. In these two circulars, employers can lay off their workers during the Covid-19 pandemic based on a mutual agreement between both parties.

Additional Information: Pandemi Covid-19 menimbulkan kerugian dalam berbagai sektor kehidupan. Kerugian yang sangat terlihat yaitu dalam kesehatan masyarakat, perekonomian dan dalam sektor lainnya. Contoh yang paling terasa adalah pada sektor perekonomian. Karena banyak Perusahaan yang terpaksa melakukan pengurangan tenaga kerja, seperti yang dialami para pekerja PT Alloy Mandiri Food yang mengalami peliburan/dirumahkan secara sepihak oleh perusahaan tanpa dibahas terlebih dahulu dengan serikat pekerja atau dengan wakil pekerja. Penelitian ini akan mengangkat permasalahan dalam bidang hukum perdata khususnya dibidang ketenagakerjaan, pokok permasalahan yang akan dibahas yaitu apakah dapat dibenarkan untuk meliburkan para pekerja akibat pandemi Covid-19 dan apa yang menjadi dasar pertimbangan hakim dalam putusan PHI PN Serang No. 20/Pdt.SUS-PHI/2021 menolak gugatan dari para penggugat (para pekerja PT Alloy Mandiri Food) sesuai dengan Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan. undang-undang ketenagakerjaan mengatur hubungan pekerja dengan pengusaha semata-mata untuk memberikan batasan-batasan tertentu dan melindungi pekerja sebagai pihak yang lebih lemah dari pengusaha agar terjamin hak-haknya begitupula sebaliknya, yang kemudian munculah konsep perlindungan hukum. Adanya aturan dan pelaksanaan perundang-undangan menimbulkan kepastian hukum. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif menemukan kebenaran koherensi, adakah aturan hukum sesuai dengan norma hukum dan adakah norma yang berupa perintah atau larangan itu sesuai dengan prinsip hukum. Perumahan/dirumahkannya para pekerja diatur dalam Surat Edaran Menteri Tenaga Kerja Nomor: SE-907/MEN/PHI-PPHI/X/2004 tentang Pencegahan Pemutusan Hubungan Kerja Massal serta dalam Surat Edaran Menteri Tenaga Kerja Nomor M/3/HK.04/III/2020 tentang perlindungan pekerja atas buruh dan kelangsungan usaha dalam rangka pencegahan dan penanggulangan Covid-19. Dalam kedua surat edaran tersebut pengusaha dapat merumahkan pekerjanya semasa pandemi Covid-19 berdasarkan kesepakatan bersama antara kedua belah pihak.
