Abstract

Poaching that leads to illegal trade and the destruction of natural habitats of wild animals are the main causes of the rarity of many species, including the Flores Hawk. There are two questions that arise, namely how is the Endangered Species protection policy in the Convention on International Trades on Endangered Species of Wild Flora and Fauna (CITES) 1975? And what is the role of the Convention on International Trades on Endangered Species of Wild Flora and Fauna (CITES) 1975 in the protection of Endangered Species in Indonesia, especially the Flores Hawk? The theory of Legal Certainty, Legal Protection and Transformation is the basic theory that researchers use. This research was conducted using qualitative juridical research methods and with analytical descriptive research specifications. The results of this study are first, The role of CITES is to regulate and moderate international trade in plants and animals to ensure that such trade does not threaten their survival. Control carried out by CITES in the trade of species that are experiencing an extinction crisis by classifying protection based on the Appendix. The classification of protected animals and plants is divided into three levels, namely Appendix I, Appendix II and Appendix III. Secondly, the Presidential Decree of the Republic of Indonesia Number 43 of 1978 concerning the ratification of the Convention on International Trade in Endangered Species of Wild Flora and Fauna (This regulation ratifies CITES into and is the core of CITES implementation regulations in Indonesia) and the State Law of the Republic of Indonesia Number 5 of 1990 concerning the Conservation of Natural Resources and Ecosystems (The Basis for the Implementation of CITES in Indonesia) are the 2 most important regulations because they are considered as the pioneers and the basis of the regulations that came after. Meanwhile, the Flores Hawk itself is protected by the government, in accordance with Government Regulation PP Number 7 of 1999 concerning the Preservation of Plant and Animal Species, as its appendix has been amended through PermenLHK Number 92 of 2018.

Terdapat dua pertanyaan yang muncul yaitu bagaimana kebijakan pelindungan Endangered Species dalam Convention on International Trades on Endangered Species of Wild Flora and Fauna (CITES) Tahun 1975? Dan apa peran dari Convention on International Trades on Endangered Species of Wild Flora and Fauna (CITES) Tahun 1975 dalam pelindungan Endangered Species di Indonesia khususnya Elang Flores? Teori Kepastian Hukum, Pelindungan Hukum, dan Transformasi menjadi teori dasar yang peneliti gunakan. Penelitian ini dilakukan dengan menggunakan metode penelitian yuridis kualitatif dan dengan spesifikasi penelitian deskriptif analitis. Hasil dari penelitian ini adalah pertama, Peran CITES adalah untuk mengatur dan memoderasi perdagangan internasional tumbuhan dan hewan untuk memastikan bahwa perdagangan tersebut tidak mengancam kelangsungan hidup mereka. Pengendalian yang dilakukan oleh CITES dalam perdagangan spesies yang mengalami krisis kepunahan dengan melakukan penggolongan pelindungan yang berdasarkan Appendix. Penggolongan satwa dan tumbuhan yang dilindungi terbagi menjadi tiga tingkatan yaitu Appendix I, Appendix II dan Appendix III. Kedua, Keputusan Presiden Republik Indonesia Nomor 43 tahun 1978 tentang pengesahan Convention on International Trade in Endangered Species of Wild Flora and Fauna (Peraturan ini yang meratifikasi CITES ke dalam dan merupakan inti dari peraturan pelaksanaan CITES di Indonesia) dan Undang-undang Negara Republik Indonesia Nomor 5 tahun 1990 mengenai Konservasi Sumber Daya Alam dan Ekosistemnya (Dasar Penerapan CITES di Indonesia) adalah 2 Peraturan yang dianggap paling penting karena dianggap sebagai Pelopor dan Dasar dari peraturan-peraturan yang muncul setelahnya. Sedangkan Elang Flores sendiri dilindungi oleh pemerintah, sesuai dengan Peraturan Pemerintah PP Nomor 7 tahun 1999 tentang Pengawetan Jenis Tumbuhan dan Satwa, sebagaimana lampirannya telah diubah melalui PermenLHK Nomor 92 tahun 2018.
