Abstract

Employment is everything related to labor before, during and after the employment period. The role of workers is very important in efforts to increase national development, so legal protection for workers must be considered for the implementation of labor rights in order to create legal certainty for workers, including through the implementation of occupational safety and health guarantees (K3). Disabled workers are workers who are vulnerable to work accidents and the law specifically regulates this. So it is hoped that all consequences that will arise in the work environment can be detected early which in turn can create a safe, stable and controlled atmosphere in the employment sector. Based on the background of this problem, it can be identified the problem of how to fulfill the safety guarantees for workers with disabilities based on Law Number 13 of 2003 concerning Employment (Case Study at Sunyi Coffee Alam Sutera Cafe) and what legal measures are taken by workers with disabilities if their rights are not fulfilled. . This research uses normative juridical research with the approach used in writing this thesis, the author uses a statutory, case and conceptual approach. The data collection techniques used by researchers in this research were through literature study techniques, interviews, and observations. Meanwhile, the data analysis that the author uses is qualitative analysis. Based on problem identification, it can be seen that there are still many efforts that have not been made by Sunyi Coffee Alam Sutera in protecting its workers so that it can be said that justice at Sunyi Coffee cannot be said to be fair & non-discriminatory, then related to the second identification it can be seen that the efforts that can be made by the workers to demand their rights, namely by submitting complaints to the employer.

Additional Information: Ketenagakerjaan adalah segala hal yang yang berhubungan dengan tenaga kerja pada waktu sebelum, selama dan sesudah masa kerja. Peran pekerja sangat penting dalam upaya peningkatan pembangunan nasional, maka perlindungan hukum kepada tenaga kerja harus diperhatikan bagi terlaksananya hak-hak tenaga kerja agar tercipta kepastian hukum bagi tenaga kerja diantaranya melalui pelaksanaan terhadap jaminan keselamatan dan kesehatan kerja (K3). Pekerja disabilitas merupakan pekerja yang rentan terhadap kecelakaan kerja dan juga undang-undang mengaturnya secara khusus. Sehingga diharapkan segala akibat yang akan timbul dalam lingkungan kerja dapat dideteksi secara awal yang pada gilirannya dapat menciptakan suasana yang aman, stabil dan terkendali di bidang ketenagakerjaan. Berdasarkan latar belakang masalah tersebut dapat diidentifikasikan masalah Bagaimana Pemenuhan Jaminan Keselamatan Pekerja Disabilitas Berdasarkan Undang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan (Studi Kasus Pada Sunyi Coffee Alam Sutera Cafe) dan Bagaimana Upaya Hukum yang Dilakukan Para Tenaga Kerja Disabilitas Apabila Hak-Haknya Tidak Terpenuhi. Penelitian ini menggunakan penelitian yuridis normatif dengan pendekatan yang digunakan dalam penulisan skripsi ini penulis menggunakan pendekatan undang-undang, kasus dan konseptual. Teknik pengumpulan data yang dilakukan peneliti dalam penelitian ini adalah melalui teknik studi kepustakaan, wawancara, serta pengamatan dan observasi. Sementara analisis data yang yang penulis gunakan yaitu analisis kualitatif. Berdasarkan identifikasi masalah dapat diketahui bahwa masih terdapat banyak upaya yang belum dilakukan oleh Sunyi Coffee Alam Sutera dalam melindungi pekerjanya sehingga dapat dikatakan bahwa keadilan di Sunyi Coffee belum dapat dikatakan adil & non diskriminasi, kemudian terkait identifikasi kedua dapat diketahui bahwa upaya yang dapat dilakukan oleh para pekerja untuk menuntut haknya, yaitu dengan mengajukan keluhan-keluhan kepada pengusaha.
