Abstract
After the COVID-19 pandemic took place in early 2021, PT. Panarub Industry conducts Termination of Employment (PHK) and Unilateral Wage Cuts to its workers, citing efficiency due to the impact of the COVID-19 pandemic. In this case, the company does not provide information related to previous wage deductions to workers, thus harming the workers. This study aims to determine whether the COVID-19 pandemic can or cannot be used as a reason for companies to unilaterally cut wages justified in Law of the Republic of Indonesia Number 13 of 2003 concerning Manpower and to determine the protection of workers who are unilaterally cut in wages by companies due to the COVID-19 pandemic. In this study, researchers used two theories as analysis knives, as for the first theory, the theory of legal justice and the second theory of legal protection. Furthermore, in this study, researchers use a type of normative juridical law research by using secondary data as research data on concepts and main cases and using the approach to laws that apply in society (statue approach). The results of this study can be concluded that unilateral cuts in workers' wages by companies due to the COVID-19 pandemic are not based on the law because Article 63 of the Government Regulation of the Republic of Indonesia Number 36 of 2021 does not contain reasons for outbreaks or pandemics that wage cuts can be made. If there is a change in the structure and scale of wages, it is necessary to conduct a wage review first and must be notified to all workers. To protect the normative rights of workers against unilaterally deducted wages, so that aggrieved workers can apply for settlement of industrial relations disputes in accordance with Law of the Republic of Indonesia Number 2 of 2004.

Additional Information: | Pasca pandemi covid-19 berlangsung di awal tahun 2021 PT. Panarub Industry melakukan Pemutusan Hubungan Kerja (PHK) dan Pemotongan Upah Sepihak kepada para pekerjanya, dengan alasan efisiensi karena dampak dari pandemi covid-19. Dalam hal ini pihak perusahaan tidak memberikan informasi terkait pemotongan upah sebelumnya kepada para pekerja, sehingga merugikan pihak pekerja. Penelitian ini bertujuan untuk mengetahui pandemi covid-19 dapat atau tidak dapat dijadikan alasan perusahaan dalam memotong upah secara sepihak dibenarkan dalam Undang-Undang Republik Indonesia Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan untuk mengetahui perlindungan pekerja yang terkena pemotongan upah secara sepihak oleh perusahaan dengan alasan pandemi covid-19. Dalam penelitian ini peneliti menggunakan dua teori sebagai pisau analisis adapun teori tersebut yang pertama teori keadilan hukum dan yang kedua teori perlindungan hukum. Selanjutnya pada penelitian ini peneliti menggunakan jenis penelitian hukum yuridis normatif dengan menggunakan data sekunder sebagai data penelitian konsep dan kasus utama serta menggunakan pendekataan undang-undang yang berlaku di masyarakat (statue approach). Hasil penelitian ini dapat diambil kesimpulan bahwa pemotongan upah pekerja secara sepihak oleh perusahaan dikarenakan alasan pandemi covid-19 tidak berdasarkan hukum dikarenakan dalam Pasal 63 Peraturan Pemerintah Republik Indonesia Nomor 36 Tahun 2021 tidak termuat alasan wabah atau pandemi dapat dilakukan pemotongan upah. Apabila terdapat perubahan dalam struktur dan skala upah perlu dilakukan dahulu peninjauan upah serta wajib diberitahukan kepada seluruh pekerja. Untuk melindungi hak normatif dari pekerja terhadap upah yang dipotong secara sepihak, sehingga bagi pekerja yang dirugikan dapat mengajukan penyelesaian perselisihan hubungan industrial sesuai Undang-Undang Republik Indonesia Nomor 2 Tahun 2004. | |||||||||||||||
