Abstract

Indonesian Migrant Workers (PMI) are one of the country's 2nd largest foreign exchange contributors recorded in 2023, reaching IDR 159.6 trillion per year, earning PMI the title of foreign exchange hero. However, despite the positive things, there are negative things that follow, including inhumane treatment of migrant workers, such as being victims of violence or other treatment that violates human rights. Based on this background, the researcher identified two problems, namely how to implement BP3MI Banten's authority in placing PMI and what are the obstacles to implementing BP3MI Banten's authority in placing PMI. The theories used are authority theory and legal protection theory. This research uses empirical juridical. The research specifications used are analytical descriptive research, using primary and secondary data sources. The data collection techniques for this research are field research and literature. Data analysis uses a qualitative approach. The research results showed that the authority and role of BP3MI had been carried out in accordance with applicable regulations, namely Perka BP2MI Number 6 of 2022 concerning the Organization and Work Procedures of BP3MI which was mandated by BP2MI. Implementation of the Placement of Indonesian Migrant Workers is divided into three bodies, namely Government to Government (G to G), Government to Private (G to P); The Indonesian Migrant Worker Placement Company is Private to Private (P to P), and for the Company's Own Interests (UKPS). Protection of Indonesian Migrant Workers includes before, during and after work, the protection provided is in the form of administrative protection, social protection and legal protection. Obstacles in implementing the placement are the lack of readiness on the part of PMI; Mistakes from private PMI recruiters; Lack of qualified human resources; Banten people's low interest in working abroad; Lack of understanding among the people of Banten regarding Placement Implementation. These obstacles show that the implementation of placement and efforts to provide legal protection for PMI have not been fully realized, because several problems still occur for which legal protection should be provided in order to provide a sense of security, both before, during and after work.

Additional Information: Pekerja Migran Indonesia (PMI) merupakan salah satu penyumbang devisa negara terbesar ke-2 yang tercatat pada tahun 2023 dengan mencapai Rp159,6 triliun pertahun, hingga PMI mendapat sebutan pahlawan devisa. Namun didalam hal positif terdapat hal negatif yang mengikutinya diantaranya masih terjadi perlakuan yang tidak manusiawi terhadap pekerja migran, seperti menjadi korban kekerasan maupun perlakuan lain yang melanggar HAM. Berdasarkan latar belakang tersebut, peneliti mengambil dua identifikasi masalah yaitu bagaimana pelaksanaan kewenangan BP3MI Banten dalam penempatan PMI dan bagaimana hambatan pelaksana kewenangan BP3MI Banten dalam penempatan PMI. Teori yang digunakan teori kewenangan dan teori perlindungan hukum. Penelitian ini menggunakan yuridis empiris. Spesifikasi penelitian yang digunakan penelitian deskriptif analitis, menggunakan sumber data primer dan sekunder. Teknik pengumpulan data penelitian ini yaitu penelitian lapangan dan kepustakaan. Analisis data mengunakan pendekatan kualitatif. Hasil penelitian diperoleh bahwa kewenangan dan peran dari BP3MI sudah dilaksankan sesuai dengan peraturan yang berlaku yang, yakni Perka BP2MI Nomor 6 Tahun 2022 Tentang Organisasi dan Tata Kerja BP3MI yang dimandatkan oleh BP2MI. Pelaksanaan Penempatan Pekerja Migran Indonesia terbagi menjadi tiga yaitu badan yaitu Government to Government (G to G), Government to Private (G to P); Perusahaan Penempatan Pekerja Migran Indonesia yaitu Private to Private (P to P) , dan Untuk Kepentingan Perusahaan sendiri(UKPS). Pelindungan Pekerja Migran Indonesia meliputi sebelum, saat, dan setelah bekerja, perlindungan yang diberikan berupa perlindungan administratif, perlindungan sosial, serta perlindungan hukum. Hambatan dalam pelaksanaan penempatan yaitu kurangnya kesiapan dari pihak PMI; Kesalahan dari pihak swasta perekrut PMI; Kurangnya SDM yang sesuai kualifikasi; Rendahnya minat masyarakat Banten dalam bekerja ke luar negeri; Kurangnya pemahaman mayarakat Banten terkait Pelaksanaan Penempatan. Hambatan tersebut menunjukan bahwa pelaksanaan penempatan dan upaya perlindungan hukum bagi para PMI belum sepenuhnya terwujud, dikarenakan masih terjadi beberapa masalah yang seharusnya perlindungan hukum diberikan demi memberikan rasa aman, baik sebelum, saat, dan setelah bekerja.
