Abstract
In the criminal justice system run by law enforcement officials, they must pay attention to the rights of suspects or defendants. However, in the process of examining the PT Krakatau Steel corruption criminal case, there was a neglect of legal obligations by law enforcement officials regarding the fulfillment of the defendant's rights. Based on this, the main problem studied in this research is how the process of delay in the criminal justice process for criminal acts of corruption in the PT Krakatau Steel case and what form of criminal responsibility there is for law enforcement officials for delays in the criminal justice process for criminal acts of corruption in the case of PT Krakatau Steel (Legal Studies Serang District Court Decision). The theories used in this research are the principle of simple, fast and low-cost justice and the theory of criminal responsibility. This research was conducted using normative juridical methods. The data source used uses secondary data sources from primary legal materials, then analyzed qualitatively. The results of this research show that in the process of examining the criminal corruption case in the PT Krakatau Steel case, during the evidentiary process at trial, which is part of the prosecution stage in the criminal justice process, there were often delays of up to 7 times by the prosecutor and substitute ad hoc judge. The form of criminal responsibility for law enforcement officials for delays in the criminal justice process for the criminal act of corruption in the PT Krakatau Steel case is the prosecutor and substitute ad hoc judge for their actions in delaying the trial by not obeying statutory orders by officials as a form of contempt of justice (contempt). of court). So that the substitute ad hoc prosecutor and judge can be held criminally responsible under Article 216 paragraph (1) of the Criminal Code concerning Crimes Against Public Authorities which can be threatened with imprisonment for a maximum of four months and two weeks or a fine of a maximum of nine thousand rupiah. Based on this, the criminal justice process can run effectively and efficiently, this is to avoid long detention for the defendant due to the uncertainty of the judge's decision being accepted.ent of four months and two weeks or a maximum fine of nine thousand rupiah.

| Additional Information: | Pada proses pemeriksaan perkara tindak pidana korupsi PT Krakatau Steel ini, adanya pengabaian kewajiban hukum oleh aparat penegak hukum terhadap pemenuhan hak-hak terdakwa. Permasalahan utama yang dikaji dalam penelitian ini yaitu bagaimana proses penundaan dalam proses peradilan pidana tindak pidana korupsi kasus PT Krakatau Steel dan bagaimana bentuk pertanggungjawaban pidana terhadap aparat penegak hukum atas penundaan dalam proses peradilan pidana tindak pidana korupsi kasus PT Krakatau Steel (Studi Hukum Putusan Pengadilan Negeri Serang). Teori yang dipakai pada penelitian ini yaitu Asas Peradilan Sederhana, Cepat dan Biaya Ringan dan teori Pertanggungjawaban Pidana. Penelitian ini dilakukan dengan menggunakan metode yuridis normatif. Sumber data yang digunakan menggunakan sumber data sekunder dari bahan hukum primer. Hasil penelitian ini bahwa dalam proses pemeriksaan perkara tindak pidana korupsi kasus PT Krakatau Steel pada proses pembuktian di persidangan yang merupakan bagian dari tahap penuntutan dalam proses peradilan pidana sering terjadi penundaan hingga 7 kali oleh jaksa dan hakim ad hoc pengganti. Bentuk pertanggungjawaban pidana terhadap aparat penegak hukum atas penundaan dalam proses peradilan pidana tindak pidana korupsi kasus PT Krakatau Steel yaitu jaksa dan hakim ad hoc pengganti atas perbuatannya yang melakukan penundaan persidangan dengan tidak menuruti perintah menurut undang-undang oleh pejabat sebagaimana bentuk penghinaan terhadap peradilan (contempt of court). Sehingga jaksa dan hakim ad hoc pengganti tersebut dapatlah dimintai pertanggungjawaban secara pidana dengan Pasal 216 ayat (1) KUHP tentang Kejahatan Terhadap Penguasa Umum yang dapat diancam dengan pidana penjara paling lama empat bulan dua minggu atau pidana denda paling banyak sembilan ribu rupiah. | |||||||||
