Abstract
In Indonesia, one of the ownership rights to land is a certificate, a certificate is a strong and authentic legal evidence. The strength of the certificate is a guarantee of legal certainty for the certificate holder as perfect evidence as long as there is no opposing party who proves otherwise. The involvement of the land mafia in land disputes is one of the causes. Land Ownership Due to the fraudulent abuse of authority by the land mafia in Salambaran Jaya Kosambi Village, Tangerang Regency, and the Indonesian Police Anti-Land Mafia Task Force handled 69 cases related to the land mafia. Identify the problem, namely, what is the legal protection for ownership of land title certificates that are misused by the land mafia in Salambaran Jaya Kosambi village, Kosambi sub-district, Tangerang regency? What factors and legal sanctions must be determined due to the rise of the land mafia in Selembaran Jaya village, Kosambi District, Tangerang Regency according to Article 39 paragraph (1) UUPA and PP No. 24 of 1997 concerning the right to seize ownership of land title certificates after a High Court decision Banten? The theories used are legal protection theory, justice theory and legal certainty theory. The research method is normative juridical research with analytical descriptive research. The type of data used is primary legal material and secondary legal material using library study data collection techniques. The results of the research show that the land mafia in Salembaran Jaya village, Kosambi District, Kab. Tangerang has not sided with the rights of the legal owner as stipulated in Article 39 paragraph (1) PP.No. 24 of 1997 in conjunction with UU.N0 50 of 1960 concerning UUPA, proven by the decision regarding the land grabbing process from the First Court until the Banten High Court issued a decision which reached the cassation level to the Supreme Court. Previously it was won by the owner of the land rights (Ahmad Gozali), finally The Supreme Court's cassation decision submitted by the PK by the Land Mafia (Tony Permana) was won by the Supreme Court on the grounds that it had already agreed, even though in the PT. has no legal force because it has capital with the letter C and girik as evidence which does not have absolute legal force.

Terlibatnya mafia tanah dalam sengketa tanah salah satu penyebabnya. Kepemilikan Tanah Atas penyalahgunaan wewenang oleh mafia tanah di Desa Salambaran jaya Kosambi Kabupaten Tangerang yang direkayasa, dan Satgas Anti-Mafia tanah kepolisian RI menangani sebanyak 69 perkara terkait dengan mafia tanah. Identifikasi masalah yaitu, Bagaimana Perlindungan Hukum terhadap kepemilikan sertifikat hak atas tanah yang disalahgunakan oleh mafia tanah di desa Salambaran Jaya Kosambi Kecamatan Kosambi Kabupaten Tangerang? Faktor-faktor dan sanksi Hukum apa yang harus ditetapkan dengan maraknya mafia tanah di desa Selembaran Jaya Kecamatan Kosambi Kabupaten Tangerang menurut Pasal 39 ayat (1) UUPA dan PP No.24 Tahun 1997 tentang hak penyerobatan kepemilikan Sertifikat hak atas tanah setelah adanya putusan Pengadilan Tinggi Banten? Teori yang digunakan adalah teori Perlindungan hukum, Teori Keadilan dan Teori Kepastian Hukum. Metode Penelitian yaitu Penelitian Yuridis Normatif dengan jenis penelitian deskriptif analitis. Jenis data yang digunakan bahan hukum primer dan bahan hukum sekunder dengan menggunakan teknik pengumpulan data studi kepustakaan. Hasil penelitian menunjukan bahwa para mafia tanah di desa Salembaran jaya Kec.Kosambi Kab. Tangerang belum berpihak kepada hak pemilik yang sah sebagaimana ketentuan aturan Pasal 39 ayat (1) PP.No. 24 Tahun 1997 Jo UU.N0 50 Tahun 1960 tentang UUPA, terbukti dengan adanya putusan atas proses penyerobotan tanah dari Pengadilan Pertama sampai dikeluarkan keputusan Pengadilan Tinggi Banten yang sampai tingkat Kasasi ke Mahkamah Agung Tadinya dimenangkan oleh pemilik hak atas tanah (Ahmad Gozali), akhirnya keputusan kasasi MA yang diajukan PK oleh pihak Mafia Tanah (Tony Permana) dimenangkan oleh pihak Mahkamah Agung dengan alasan sudah inkrah, padahal pada putusan PT.Banten seharusnya pihak MA harus memenangkan pihak pemilik tanah (Ahmad Gozali) namun dengan dalih bukti yang diajukan pemilik tanah tidak mempunyai kekuatan hukum karena bermodal dengan leter C dan girik sebagai alat bukti yang tidak mempunyai kekuatan hukum mutlak. | |||||||||
