Abstract

Appendix I to Law Number 13 of 2022 the Second Amendment to Law Number 12 of 2011 concerning the Establishment of Laws and Regulations states the formation of academic manuscripts using certain methods, namely Regulatory Impact Analysis (RIA) and Rule, Opportunity, Capacity, Communication, Interest, Process, Ideology (ROCCIPI) as a formulation to create regulations. The application of RIA and ROCCIPI in the Preparation of Academic Manuscripts of the Draft Law if reviewed in the Academic Paper of the Draft Law on the Development and Strengthening of the Financial Sector (NA RUU P2SK) has not fully implemented RIA and ROCCIPI. The problem identification from this study is How to Apply RIA and ROCCIPI in the Draft Law on the Development and Strengthening of the Financial Sector and How are the Obstacles to the Application of RIA and ROCCIPI in the Draft Law on the Development and Strengthening of the Financial Sector. The theories used in this study are Statutory Theory and Legal System Theory. The Method Used in the Preparation of this Thesis is the Normative Juridical Method which uses laws and regulations and legal principles in conducting research. The data sources used in this study are primary and secondary data sources that are analyzed qualitatively. The research results of this thesis are the Application of the RIA and ROCCIPI Methods in the formation of laws, especially the NA RUU P2SK based on the Organization for Economic Cooperation and Development (OECD) as the initiator of the RIA method and Ann Seidman and Robert B. Seidman as the initiators of the ROCCIPI method. The use of RIA and ROCCIPI Methods in NA RUU P2SK is adjusted to existing guidelines according to OECD and Ann Seidman and Robert B. Seidman. The obstacle to the application of the RIA and ROCCIPI methods in the NA RUU P2SK is that it has not fully implemented the RIA method formed by the OECD and does not apply the ROCCIPI method. The application of the RIA and ROCCIPI Methods has not been thoroughly applied to the NA RUU P2SK.

Identifikasi masalah dari penelitian ini adalah Bagaimana Penerapan RIA dan ROCCIPI dalam Rancangan Undang-Undang tentang Pengembangan dan Penguatan Sektor Keuangan dan Bagaimana kendala Penerapan RIA dan ROCCIPI dalam Rancangan Undang-Undang tentang Pengembangan dan Penguatan Sektor Keuangan. Teori yang digunakan dalam penelitian ini adalah Teori Perundang-undangan dan Teori Sistem Hukum. Metode yang Digunakan dalam Penyusunan Skripsi ini adalah Metode Yuridis Normatif yang menggunakan peraturan perundang-undangan serta asas-asas hukum dalam melakukan penelitian. Sumber data yang digunakan dalam penelitian ini adalah sumber data primer dan sekunder yang dianalisis secara kualitatif. Hasil penelitian dari skripsi ini adalah Penerapan Metode RIA dan ROCCIPI dalam NA RUU P2SK dengan berdasarkan pada Organization for Economic Cooperation and Developement (OECD) sebagai penggagas metode RIA dan Ann Seidman dan Robert B. Seidman sebagai penggagas metode ROCCIPI. Penggunaan Metode RIA dan ROCCIPI pada NA RUU P2SK disesuaikan dengan pedoman yang ada sesuai OECD serta Ann Seidman dan Robert B. Seidman. Kendala dari Penerapan Metode RIA dan ROCCIPI dalam NA RUU P2SK adalah belum menerapkan secara menyeluruh metode RIA yang dibentuk oleh OECD dan tidak menerapkan metode ROCCIPI. Penerapan Metode RIA dan ROCCIPI belum diterapkan secara menyeluruh pada NA RUU P2SK.
