Abstract
The National Land Office Lebak Regency In 2020, through the Complete Systematic Land Registration (PTSL) program, published freehold tittlle land on Pasir Eurih customary forest land which should be based on the provisions in the Decree of the Environment and Forestry Minister of the Republic of Indonesia Number: SK.1547 /MENLHK PSKL/PKTHA/KUM.1/2/2019 Regarding the Determination of the Kasepuhan Pasir Eurih Traditional Forest, BPN refuses application for the issuance of a Land freehold tittle Certificate. Based on this background, it is necessary to study of how the Land validity of Freehold Tittle published by Lebak National Land Agency on Pasir Eeurih Customary Forest Land, Sindanglaya Village, Sobang District, Lebak Regency? And what legal efforts can be taken to preserve customary law? The theory used in this research is the theory of legal certainty. The theory used is the theory of legal certainty. The method used is empirical juridical supported by normative juridical research, with research specifications in the form of analytical descriptive, data sources in the form of primary data and secondary data, data collection techniques in the form of field research (interviews) and library research, data analysis using normative descriptive, and research location in Sindanglaya Village, Sobang District, Lebak Regency, and BPN Lebak. The results of this research show that the Certificate of freehold tittle covering an area of 217 m2 located on the Pasir Eurih Forest Customary land, Sindanglaya Village, Sobang District, does not comply with the regulations in the Decree of the Minister of Environment and Forestry of the Republic of Indonesia Number: SK.1547/MENLHK PSKL/PKTHA /KUM.1/2/2019 Regarding the Determination of the Kasepuhan Pasir Eurih Traditional Forest, namely in the seventh paragraph it is stated that the Customary Forest as in the first paragraph may not be bought and sold and transferred to other parties, so that its administrative law is declared defective and invalid. Legal measures that can be taken in the context of preserving customary law are by re-checking the validity of data on land objects and preventive steps to ensure that similar mistakes do not happen again is by carrying out socialization regarding the Decree of the Minister of Environment and Forestry of the Republic of Indonesia above to the people of Kasepuhan Pasir Eurih and the community, Sindanglaya village.

| Additional Information: | Badan Pertanahan Nasional (BPN) Kabupaten Lebak Pada tahun 2020 melalui program Pendaftaran Tanah Sistematis Lengkap (PTSL) menerbitkan sertifikat tanah hak milik di atas lahan hutan adat Pasir Eurih yang seharusnya berdasarkan ketentuan didalam Keputusan Menteri Lingkungan Hidup dan Kehutanan Republik Indonesia Nomor: SK.1547/MENLHK PSKL/PKTHA/KUM.1/2/2019 Tentang Penetapan Hutan Adat Kasepuhan Pasir Eurih, BPN menolak pengajuan penerbitan Sertifikat Tanah Hak Milik tersebut. Berdasarkan latar belakang tersebut perlu dikaji mengenai bagaimana keabsahan Sertifikat Hak Milik atas tanah yang diterbitkan Badan Pertanahan Nasional BPN Lebak di atas Lahan Hutan Adat Pasir Eeurih Desa Sindanglaya Kecamatan Sobang Kabupaten Lebak? Dan bagaimana upaya hukum yang dapat dilakukan dalam rangka Pelestarian Hukum Adat?. Teori yang digunakan yaitu teori kepastian hukum. Metode yang digunakan adalah yuridis empiris didukung dengan penelitian yuridis normatif, dengan spesifikasi penelitian berupa deskriptif analitis, sumber datanya berupa data primer dan data sekunder, teknik pengumpulan data berupa penelitian lapangan (wawancara) dan penelitian kepustakaan, analisis datanya menggunakan deskriptif normatif, dan lokasi penelitiannya di Desa Sindanglaya Kecamatan Sobang Kabupaten Lebak, dan BPN Lebak. Hasil Penelitian ini menunjukan bahwa Sertifikat Hak Milik atas tanah seluas 217 m2 yang berada di atas lahan Adat Hutan Pasir Eurih Desa Sindanglaya kecamatan Sobang tidak memenuhi aturan yang ada dalam Keputusan Menteri Lingkungan Hidup dan Kehutanan Republik Indonesia Nomor: SK.1547/MENLHK PSKL/PKTHA/KUM.1/2/2019 Tentang Penetapan Hutan Adat Kasepuhan Pasir Eurih, yaitu pada amar ketujuh dinyatakan bahwa Hutan Adat sebagaimana pada amar kesatu tidak boleh diperjualan belikan dan dipindahtangankan kepada pihak lain, sehingga dinyatakan cacat hukum administrasinya dan tidak absah. Upaya hukum yang dapat dilakukan dalam rangka pelestarian hukum adat adalah dengan dilakukan pengecekan kembali kevalidan data atas objek tanah dan langkah preventif agar tidak terulang kembali kesalahan serupa adalah dengan dilaukannya sosialisasi terkait Keputusan Menteri Lingkungan Hidup dan Kehutanan Republik Indonesia diatas kepada masyarakat Kasepuhan Pasir Eurih dan masyaraat desa Sindanglaya. | |||||||||
