Abstract

The implementation of the Retribution for the Extension of Foreign Worker Permits in Cilegon City is not in accordance with the terms and conditions that should be regulated in Government Regulation Number 34 of 2021 concerning the Use of Foreign Workers and Cilegon City Regional Regulation Number 11 of 2022 concerning Levy for the Use of Foreign Workers. As for the identification of the problem, how is the levy for extending foreign worker permits as regional income in Cilegon City based on Cilegon City Regional Regulation Number 11 of 2022 concerning levies for the use of foreign workers and, what are the obstacles to the Cilegon City Manpower Service in implementing the levy for extending foreign worker permits? ?. The theories used are, authority theory and law enforcement theory. The method used in this research is empirical juridical with data analysis through a qualitative approach using primary data in the form of interviews with the Cilegon City Manpower Office. Secondary data sources consist of primary legal materials, secondary legal materials and tertiary legal materials. The results of the research obtained were that the implementation of the role of the Cilegon City Manpower Service in implementing the levy for extending permits for foreign workers in Cilegon City was not carried out optimally. Conclusion: The implementation of the role of the Cilegon City Manpower Service in implementing levies for extending foreign worker permits, which is the source of the delegation's authority, is not fully implemented, because there are still many violations committed by foreign workers who do not have work permit visas and do not extend work permit visas and levies. regional income has reached 84.13 percent of the target of the Cilegon City Regional Government. Obstacles in implementing the extension of foreign worker permits include a lack of legal culture in terms of law enforcement, minimal awareness of foreign workers regarding the importance of work permit visas, lack of supervision by the Cilegon City Manpower Service and lack of strict sanctions from law enforcers. Suggestions, the Cilegon City Manpower Department should be stricter in the use of foreign workers by regularly checking the validity period of work permit visas held by foreign workers so that levies can be collected maximally in the use and extension of foreign worker permits in Cilegon City.

Adapun identifikasi masalahnya, Bagaimana Pelaksanaan Retribusi Perpanjangan Izin Tenaga Kerja Asing sebagai Pendapatan Daerah di Kota Cilegon Berdasarkan Peraturan Daerah Kota Cilegon Nomor 11 Tahun 2022 tentang Retribusi Penggunaan Tenaga Kerja Asing dan, Bagaimana Hambatan Dinas Tenaga Kerja Kota Cilegon dalam Pelaksaan Retribusi Perpanjangan Izin Tenaga Kerja Asing?. Teori yang digunakan yaitu, teori kewenangan dan teori penegakan hukum. Metode yang digunakan dalam penelitian ini yuridis empiris dengan analitis data melalui pendekatan kualitatif menggunakan data primer berupa wawancara kepada pihak Dinas Tenaga Kerja Kota Cilegon, sumber data sekunder terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian yang di dapat, implementasi peran Dinas Tenaga Kerja Kota Cilegon terhadap pelaksaan retribusi perpanjangan izin tenaga kerja asing di Kota Cilegon tidak terlaksana dengan optimal. Kesimpulan, Implementasi peran Dinas Tenaga Kerja Kota Cilegon dalam pelaksanaan retribusi perpanjangan izin tenaga kerja asing yang merupakan sumber kewenangan delegasi tidak seluruhnya terlaksana, karena masih banyak pelanggaran yang dilakukan oleh tenaga kerja asing yang tidak memiliki visa izin bekerja dan tidak memperpanjang visa izin kerja dan retribusi daerah dalam pendapatan daerah sudah masuk 84,13 persen dari target Pemerintah Daerah Kota Cilegon. Kendala dalam pelaksanaan perpanjangan izin tenaga kerja asing yaitu, kurangnya budaya hukum secara aspek penegakan hukum, minimnya kesadaran tenaga kerja asing terhadap pentingnya visa izin kerja dan kurang pengawasan pihak Dinas Tenaga Kerja Kota Cilegon serta kurang tegasnya sanksi dari para penegak hukum. Saran, Dinas Tenaga Kerja Kota Cilegon harus lebih ketat dalam penggunaan tenaga kerja Asing dengan melakukan pengecekan secara berkala terhadap masa berlakunya visa izin bekerja yang dimiliki tenaga kerja asing agar penarikan retribusi bisa maksimal dalam penggunaan dan perpanjangan izin tenaga kerja asing di Kota Cilegon.
