Abstract

The rapid development of technology has penetrated various fields in all aspects of life. One form of technological progress in the military field is increasingly sophisticated weaponry, one of which is the Anti Satellite Weapon (ASAT). However, with the development of the technology must be followed by the product or legal arrangements that govern it. The identification of the problem in this research is first, how is the regulation of the use of Anti-Satellite Weapons based on the Outer Space Treaty 1967? Second, is the ASAT co-orbital test conducted by Russia in accordance with the 1967 Outer Space Treaty? The theory used in this research is the theory of legal certainty and the precautionary principle. The research method used is a normative juridical research method using secondary data sources consisting of primary legal materials, secondary legal materials and tertiary legal materials. The data collection technique was carried out by literature study and the analysis used in this paper using qualitative analysis by describing or explaining the subject or object of research. The findings obtained in this study are the legality of the use of anti-satellite weapons by a country, to find out the regulations governing this matter and to create a concrete legal certainty. The results of this study are first, that the regulation of the use of Anti�Satellite Weapons by a country is regulated in Article 4 of the Outer Space Treaty 1967. Second, the legality of the use of Anti-Satellite Weapons by a country is prohibited under Article 4 of the Outer Space Treaty 1967. Suggestions that the author can convey are The need for awareness by each State of the impact that will be caused when taking certain actions which in this case is the testing of Anti�Satellite Weapons.

Additional Information:	Perkembangan teknologi yang sedemikian cepat telah merambah berbagai bidang dalam segala aspek kehidupan. Salah satu bentuk dari kemajuan teknologi pada bidang militer adalah persenjataan yang semakin canggih salah satunya yaitu Anti Satellite Weapon (ASAT). Namun dengan semakin berkembangnya teknologi tersebut harus diikuti oleh produk atau pengaturan hukum yang mengaturnya. Identifikasi masalah dalam penelitian ini adalah pertama, bagaimana pengaturan penggunaan Senjata Anti Satelit berdasarkan Outer Space Treaty 1967? Kedua apakah uji coba co-orbital ASAT yang dilakukan oleh Rusia sesuai dengan Outer Space Treaty 1967?. Teori yang digunakan pada penelitian ini yaitu teori kepastian hukum dan prinsip kehati-hatian. Metode penelitian yang digunakan yaitu metode penelitian yuridis normatif dengan menggunakan sumber data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan data dilakukan dengan studi kepustakaan dan analisis yang dipakai pada penulisan ini menggunakan analisis kualitatif dengan cara menggambarkan atau memaparkan subjek atau objek penelitian. Temuan yang diperoleh dalam penelitian ini adalah Legalitas penggunaan Senjata Anti Satelit oleh suatu negara, untuk mengetahui pengaturan yang mengatur hal tersebut dan agar terciptanya suatu kepastian hukum yang konkrit. Hasil penelitian ini adalah pertama, bahwa pengaturan penggunaan Senjata Anti Satelit oleh suatu negara diatur didalam Pasal 4 Outer Space Treaty 1967. Kedua, Legalitas penggunaan Senjata Anti Satelit oleh suatu negara adalah dilarang berdasaarkan Pasal 4 Outer Space Treaty 1967. Saran yang dapat penulis sampaikan adalah Perlunya kesadaran oleh setiap Negara akan dampak yang akan ditimbulkan saat akan melakukan tindakan tertentu yang dalam hal kasus ini adalah uji coba Senjata Anti Satelit.
