Abstract
An agreement is an event where two people promise each other to carry out something from an agreement, then an agreement arises, usually one of those bound by the agreement will break the promise, in the case of South Jakarta Religious Court decision No.2752/pdt.G/2021/ PA.JS., the author will discuss identifying problems regarding the mechanism for submitting insurance claims between Donny Widharto and PT. Manulife Indonesia Sharia Unit Life Insurance in case No.2752/Pdt.G/2021/PA.JS can be said to be in accordance with or contrary to the laws in force in Indonesia and also the dispute resolution mechanism carried out by Donny Widharto and PT. Manulife Indonesia Life Insurance Sharia Unit in case No.2752/Pdt.G/2021/PA.JS can be said to have complied with the legal provisions in force in Indonesia. As for this research, it will answer the problem. To find out the filing of claims made by Donny Widharto and PT. Manulife Indonesia Life Insurance Sharia Unit in case No. 2752/Pdt.G/2021/PA.JS is in accordance with applicable laws and also to find out the dispute resolution mechanism carried out by Donny Widharto with PT. Manulife Indonesia Life Insurance Sharia Unit in case No.2752/Pdt.G/2021/PA.JS. The research method used is normative juridical, with a statutory approach, conceptual approach, and case approach. Data sources include secondary data and primary data. Data collection techniques through literature study, with qualitative juridical data analysis. The results of the research carried out by the author are that based on the evidence presented by the plaintiff, it is clear that a valid agreement has been entered into, where the agreement is classified as a sharia insurance agreement. The judge's legal considerations in deciding this case were appropriate because both parties had not yet resolved the dispute through alternative dispute resolution institutions. This is as stated in the quote from Article 14 of the general provisions of sharia insurance policies.

Asuransi Jiwa Manulife Indonesia Unit Syariah pada perkara No.2752/Pdt.G/2021/PA.JS dapat dikatakan telah sesuai atau bertentangan dengan Undang-undang yang berlaku di Indonesia dan juga mekanisme penyelesaian sengketa yang dilakukan oleh saudara Donny Widharto dengan PT. Asuransi Jiwa Manulife Indonesia Unit Syariah dalam perkara No.2752/Pdt.G/2021/PA.JS dapat dikatakan telah sesuai dengan ketentuan hukum yang berlaku di Indonesia. Adapun penelitian ini akan menjawab permalasalah Untuk mengetahui pengajuan klaim yang dilakukan oleh saudara Donny Widharto dengan PT. Asuransi Jiwa Manulife Indonesia Unit Syariah pada perkara No.2752/Pdt.G/2021/PA.JS sudah sesuai dengan Undang-undang yang berlaku dan juga Untuk mengetahui mekanisme penyelesaian sengketa yang dilakukan oleh Donny Widharto dengan PT. Asuransi Jiwa Manulife Indonesia Unit Syariah pada perkara No.2752/Pdt.G/2021/PA.JS. Metode penelitian yang digunakan yaitu yuridis normatif, dengan pendekatan perundang-undangan, pendekatan konseptual, pendekatan kasus. Sumber data berupa data sekunder dan data primer. Teknik pengumpulan data melalui studi kepustakaan, dengan analisis data yuridis kualitatif. Hasil penelitian yang penulis lakukan adalah Berdasarkan bukti-bukti yang dikemukakan oleh penggugat sudah jelas menyatakan bahwa sah telah terjadinya perjanjian, dimana perjanjian tersebut diklasifikasikan sebagai perjanjian asuransi syariah. Pertimbangan hukum hakim dalam memutuskan perkara ini sudah tepat karena kedua belah pihak sama-sama belum menempuh penyelesaian sengketa melalui lembaga alternatif penyelesaian sengketa. Hal ini sebagaimana dinyatakan pada kutipan Pasal 14 ketentuan umum polis asuransi syariah. | |||||||||
