Abstract

The development of norms regarding defamation against the president from the old Indonesian Penal Code (KUHP) to the new one has sparked both pros and cons. The article on defamation against the president in the old KUHP was considered a colonial-era provision, deemed outdated and inconsistent with the democratic principles of the Indonesian state. Consequently, the Constitutional Court invalidated that article. The new KUHP, however, reintroduced provisions on defamation against the president, generating debates on its existence. This research aims to explore how the evolution of norms on presidential defamation relates to the presence of the old and new KUHP, as well as to understand the legal consequences based on Constitutional Court Decree Number 013-022/PUU-IV/2006 and Constitutional Court Decree Number 31/PUU-XIII/2015 from the perspective of Law Number 1 of 2023 concerning the Criminal Code. The research method employed is normative juridical, a legal literature review conducted by examining existing literature or secondary data. This research serves the purpose of obtaining theories, concepts, legal principles, and regulations related to the main topic. The findings of this research reveal that the article on defamation against the president, previously present in the old KUHP, was annulled by the Constitutional Court and reintroduced in the new KUHP with some differences in its elements. The new provision includes two new elements: the existence of criminal elimination grounds and the nature of this offense as a prosecutable offense, which was previously a common offense. The legal consequence of the Constitutional Court's decision is that society and the media can easily express criticism-based defamation without legal repercussions. Therefore, it is suggested that norms regarding defamation against the president should be redefined in the new KUHP with new elements, providing benefits for all parties involved. This should be done without violating the human rights of citizens to express their opinions, in line with the principles of a democratic state, and without tarnishing the reputation of the president and vice president.

Pasal penghinaan terhadap presiden di KUHP lama dikatakan sebagai pasal kolonial yang sudah kuno dan tidak sesuai dengan prinsip demokrasi negara Indonesia, sehingga Mahkamah Konstitusi membatalkan pasal tersebut. Lalu KUHP baru kembali mengatur pasal penghinaan terhadap presiden yang dalam prosesnya menimbulkan pro dan kontra tentang keberadaan pasal ini. Penelitian ini dilakukan untuk mengetahui bagaimana perkembangan norma penghinaan terhadap presiden berkaitan dengan adanya KUHP lama dan KUHP baru dan mengetahui bagaimana akibat hukum yang ditimbulkan atas dasar Putusan Mahkamah Konstitusi Nomor 013-022/PUU�IV/2006 dengan Putusan Mahkamah Konstitusi Nomor 31/PUU-XIII/2015 dalam perspektif Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana. Metode penelitian yang digunakan adalah metode yuridis normatif. Yaitu penelitian hukum kepustakaan yang dilakukan dengan cara meneliti bahan-bahan kepustakaan atau data sekunder belaka. Penelitian ini memiliki kegunaan untuk mendapatkan bahan-bahan berupa teori-teori, konsep-konsep, asas-asas hukum serta peraturan hukum yang berhubungan dengan pokok bahasan. Adapun hasil dari penelitian ini adalah pasal penghinaan terhadap presiden yang sebelumnya dimuat dalam KUHP lama kemudian dibatalkan oleh Putusan Mahkamah Konstitusi, kembali dimuat oleh KUHP baru dengan memiliki perbedaan dalam unsurnya. Pasal penghinaan terhadap presiden di KUHP baru memiliki 2 (dua) unsur baru yaitu memiliki alasan penghapus pidana, serta delik pasal ini ialah delik aduan yang sebelumnya ialah delik biasa. Serta, akibat hukum oleh putusan Mahkamah Konstitusi ialah masyarakat dan media dengan mudah melontarkan penghinaan yang berdasar pada kritik, sehingga norma penghinaan terhadap presiden perlu diatur kembali di dalam KUHP baru dengan unsur yang baru, yang dapat menjadi keuntungan bagi semua pihak. Tanpa melanggar hak asasi manusia warga negara untuk mengemukakan pendapat sebagai bentuk negara demokrasi, dan tanpa mencoreng nama baik presiden dan wakil presiden.
