Abstract

A Boru Hutasoit woman married a man with the Siregar surname, the marriage of course used Toba Batak customs and was blessed at GBI Serang. In 2015, Boru Hutasoit's husband died, leaving behind 3 children and their assets. Boru Hutasoit, whose status changed to widow, remarried 5 years later in 2020 to another man with a different surname and was blessed by a priest from GBI Serang. This research was carried out with a focus on: What is the validity of the customary marriage of a widow who marries another man outside her late husband's clan according to Toba Batak Customary Law and what are the consequences of family law for a widow who marries another man outside her deceased clan? husband according to Toba Batak Customary Law. The theoretical framework that the author uses is the ball theory and Mungkret Mulur. The research method used in writing this thesis is an empirical juridical or sociological juridical method, which will rely on primary data and secondary data. And the author also uses a problem approach consisting of a customary law approach, a case study approach, and a conceptual approach. And the author uses data analysis in the form of qualitative data analysis. The results of the research from the case study conducted by the author are that the legality of a widow's marriage to another man outside the late husband's clan which is still within the scope of the Toba Batak Custom becomes valid if the following procedures for the parties involved are present in the marriage. There is no significant difference between the Toba Batak Customary Law in the overseas Serang region and the Toba Batak Traditional Law where it originates, with this being the case, the Toba Batak Customary Law basically still applies to its adherents. And the legal consequences are the customary sanctions against a widow who remarries another man outside her late husband's clan, namely the severance of the widow's kinship with her deceased husband, loss of maintenance rights over children, and loss of rights to the husband's property. These sanctions can increase if the widow remarries a man who is still married.

Additional Information:	Seorang perempuan boru Hutasoit menikah dengan laki-laki bermarga Siregar, pernikahan tersebut tentu menggunakan Adat Batak Toba dan diberkati di GBI Serang. Pada tahun 2015, suami daripada boru Hutasoit tersebut meninggal dunia, ia meninggalkan 3 anak beserta hartanya. Boru Hutasoit yang statusnya berubah menjadi janda, menikah kembali pada 5 tahun kemudian pada tahun 2020 dengan laki-laki lain yang berbeda marganya dan melakukan pemberkatan oleh pendeta dari GBI Serang. Penelitian ini dilaksanakan dengan mengambil fokus mengenai: Bagaimana keabsahan perkawinan adat seorang janda yang menikah dengan laki-laki lain di luar marga alhmarhum suami menurut Hukum Adat Batak Toba dan Bagaimana akibat hukum keluarga terhadap seorang janda yang menikah dengan laki-laki lain di luar marga almarhum suami menurut Hukum Adat Batak Toba. Kerangka teori yang penulis gunakan adalah teori bola dan Mulur Mungkret. Metode Penelitian yang digunakan dalam penulisan skripsi ini adalah metode yuridis empiris atau yuridis sosiologis, yang akan bertumpu pada data primer dan data sekunder. Dan juga penulis menggunakan pendekatan masalah yang terdiri dari pendekatan Hukum adat, pendekatan studi kasus, dan pendekatan konseptual. Dan penulis menggunakan analisa data berupa analisis data kualitatif. Hasil penelitian dari studi kasus yang dilakukan oleh penulis adalah Keabsahan pernikahan janda dengan laki-laki lain di luar marga almarhum suami yang masih dalam lingkup Adat Batak Toba menjadi sah apabila tata cara berikut pihak yang terlibat, ada dalam pernikahan tersebut. tidak ada perbedaan secara signifikan antara Hukum Adat Batak Toba di perantauan wilayah Serang dengan di wilayah Adat Batak Toba berasal, dengan hal ini pula maka Hukum Adat Batak Toba pada dasarnya masih berlaku bagi para penganutnya. Dan akibat hukumnya adalah sanksi adat terhadap janda yang menikah lagi dengan laki-laki lain di luar marga almarhum suami ialah putusnya kekerabatan si janda dengan almarhum suami, hilangnya hak pemeliharaan atas anak, dan hilangnya hak atas harta suami. Sanksi tersebut bisa bertambah bila si janda menikah kembali dengan laki-laki yang masih beristri.
