Abstract
Article 53 letter a of Law Number 8 of 2016 concerning Persons with Disabilities explains that the Government is obliged to employ at least 2% of disabilities from the total number of employees. Law Number 8 of 2016 concerning Persons with Disabilities is one of the policies that serves as a reference in the implementation of civil servant recruitment for disabilities. The first problem identification is, What are the recruitment procedures for civil servants for disabilities in Serang City based on Law Number 8 of 2016 concerning People with Disabilities? Then the second is what obstacles does the Serang City Government face in implementing civil servant recruitment for disabilities based on Law Number 8 of 2016 concerning People with Disabilities? The theories used are the theory of Authority and the theory of Legal Protection. The research method is empirical juridical. The research specification is descriptive analysis. The data source is primary data supported by secondary data. The data collection technique is interviews. Data was obtained and analyzed descriptively using a qualitative approach method. The results of research on civil servant recruitment procedures for disabilities in Serang City still use normal civil servant recruitment procedures, but require a doctor's certificate and also videos of daily activities during administrative selection. The implementation is not optimal because there is no accompanying team for basic competency selection and selection. field competency based on the Regulation of the Minister for Empowerment of State Apparatus and Bureaucratic Reform of the Republic of Indonesia Number 27 of 2021 concerning Procurement of Civil Servants, adequate facilities, and the absence of socialization of civil servant recruitment for disabilities. Conclusion The Serang City Government has implemented civil servant recruitment for disabilities as attribution from Law Number 8 of 2016 concerning Persons with Disabilities delegated to Serang City Regional Regulation Number 13 of 2019 concerning Persons with Disabilities, recruitment of civil servants for disabilities runs on the basis of an affirmative policy with the aim of provide protection for disabilities as a form of government that acts in a non-discriminatory manner towards vulnerable groups. The Serang City Government's advice in planning civil servant recruitment for disabilities requires a policy that regulates a special mechanism for recruiting civil servants for disabilities and adequate facilities so that it can be implemented well, so that society can change its view that disabilities have the same rights.

Additional Information: | Pasal 53 huruf a Undang-Undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas menjelaskan bahwa Pemerintah wajib mempekerjakan paling sedikit 2% penyandang disabilitas. Undang-Undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas merupakan salah satu kebijakan yang menjadi acuan dalam pelaksanaan rekrutmen pegawai negeri sipil (PNS) penyandang disabilitas. Adapun identifikasi masalah yang pertama yaitu, Bagaimana prosedur rekrutmen pegawai negeri sipil bagi penyandang disabilitas di Kota Serang berdasarkan Undang-Undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas? Kemudian yang kedua ialah Bagaimana kendala yang dihadapi Pemerintah Kota Serang terhadap pelaksanaan rekrutmen pegawai negeri sipil bagi penyandang disabilitas berdasarkan Undang-Undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas?. Teori yang digunakan ialah teori Kewenangan dan teori Perlindungan Hukum. Metode penelitian yaitu yuridis empiris. Spesifikasi penelitian yaitu deskriptif analisis. Sumber data yaitu data primer yang ditunjang oleh data sekunder. Teknik pengumpulan data adalah wawancara. Data diperoleh dan dianalisis secara deskriptif dengan metode pendekatan kualitatif. Hasil penelitian prosedur rekrutmen PNS untuk penyandang disabilitas di Kota Serang masih menggunakan prosedur rekrutmen PNS biasa, akan tetapi perlu surat keterangan dokter dan juga video aktifitas sehari-hari pada saat seleksi administrasi, pelaksanaanya belum maksimal karena belum ada tim pendamping untuk seleksi kompetensi dasar dan seleksi kompetensi bidang berdasarkan Peraturan Menteri Pendayagunaan Aparatur Negara Dan Reformasi Birokrasi Republik Indonesia Nomor 27 Tahun 2021 tentang Pengadaan Pegawai Negeri Sipil, fasilitas yang memadai, serta tidak adanya sosialisasi rekrutmen PNS untuk disabilitas. Kesimpulan Pemerintah Kota Serang telah melaksanakan rekrutmen PNS untuk penyandang disabilitas sebagaimana atribusi dari Undang-Undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas didelegasikan kepada Peraturan Daerah Kota Serang Nomor 13 Tahun 2019 tentang Penyandang Disabilitas, rekrutmen PNS untuk penyandang disabilitas berjalan atas dasar kebijakan afirmasi dengan tujuan memberikan perlindungan terhadap penyandang disabilitas sebagai wujud Pemerintahan yang bertindak secara non diskriminatif terhadap golongan rentan. Saran Pemerintah Kota Serang dalam rangka perencanaan rekrutmen PNS untuk penyandang disabilitas perlu kebijakan yang mengatur mekanisme khusus rekrutmen PNS untuk penyandang disabilitas dan fasilitas yang memadai supaya dapat terlaksana dengan baik, agar masyarakat dapat mengubah pandangannya bahwa penyandang disabilitas mendapatkan hak yang sama. | |||||||||
