Abstract
The State Civil Apparatus commonly referred to as Civil Servants (hereinafter abbreviated as PNS) are employees who carry out administrative programs and services based on their duties, main and functions for the community, but in reality, many civil servants commit disciplinary violations from mild, moderate, severe levels. the purpose of writing this thesis is to find out the law enforcement mechanism for Civil Servants to realize performance improvement at the Education and Culture Office of Serang Regency. This thesis uses empirical juridical research methods (socio-legal) by examining directly how the enactment of a legal system applies in society. In this thesis research, the research approach used is descriptive-analytical. The data sources used consist of primary data, secondary data, and data analysis is carried out by researchers using qualitative methods. The qualitative method is research that produces descriptive data analysis, which provides an overview based on data findings from previous research. Based on the research, the analysis of the Disciplinary Law Enforcement of Civil Servants to Realize Performance Improvement has not been optimally conducted by Government Regulation Number 94 of 2021. Some factors hinder the implementation of disciplinary law enforcement of civil servants to reliaze performance improvement. These factors include suboptimal supervision and the application of sanctions by statutory regulations, which contribute to the suboptimal enforcement of civil servant discipline at the Serang Regency Education and Culture Office.

Additional Information: | Aparatur Sipil Negara yang biasa disebut sebagai Pegawai Negeri Sipil (selanjutnya disingkat PNS) merupakan pegawai yang menjalankan program administarsi serta pelayanan berdasarkan tugas, pokok dan fungsinya untuk masyarakat, tetapi kenyataannya banyak sekali pegawai negeri sipil yang melakukan pelanggaran indisipliner dari tingkat ringan, sedang, berat. tujuan penulisan tesis ini mengetahui mekanisme penegakan hukum Pegawai Negeri Sipil untuk mewujudkan peningkatan kinerja pada Dinas Pendidikan dan Kebudayaan Kabupaten Serang. Tesis ini menggunakan metode penelitian yuridis empiris (sosio legal) dengan meneliti secara langsung bagaimana keberlakuan suatu sistem hukum yang berlaku dalam masyarakat. Dalam penelitian tesis ini, pendekatan penelitian yang digunakan adalah pendekatan deskriptif analitis. Sumber data yang digunakan terdiri dari data primer, data sekunder, dan analisis data dilakukan oleh peneliti dengan menggunakan metode kualitatif. Metode kualitatif merupakan suatu penelitian yang menghasilkan data deskriptif analisis, yaitu memberikan gambaran berdasarkan temuan data dari penelitian terdahulu. Berdasarkan penelitian analisa Penegakan Hukum Indisipliner Pegawai Negeri Sipil Untuk Mewujudkan Peningkatan kinerja belum optimal dilakukan sesuai dengan Peraturan Pemerintah Nomor 94 Tahun 2021. Terdapat faktor-faktor yang menghambat pelaksanaan penegakan hukum indisipliner pegawai negeri sipil untuk mewujudkan peningkatan kinerja. Faktor-faktor tersebut meliputi kurang optimalnya pengawasan dan penerapan sanksi yang sesuai dengan aturan perundang-undangan, yang berkontribusi pada kurang optimalnya penegakan indisipliner PNS pada Dinas Pendidikan dan Kebudayaan Kabupaten Serang. | |||||||||
