Abstract
Power outages that occur have a negative impact on the people of Indonesia, namely experiencing losses. Based on Article 29 paragraph (1) letter e of Law Number 30 of 2009 concerning Electricity, consumers can ask for compensation if you get losses that occur due to power outages that cause losses. Researchers are interested in examining how the responsibility of PT. Perusahaan Listrik Negara against losses of household consumers caused by errors or negligence in operation by holders of electricity provider business licenses in Tangerang Regency based on Law Number 30 of 2009 concerning Electricity? And How is the Process of Implementing a Claim for Compensation Loss by Household Consumers of Electricity Users to PT. State Electricity Company Based on Law Number 30 of 2009 concerning Electricity? This research uses sociological empirical juridical methods, using analytical descriptive research specifications. Using primary data sourced from the field in the form of interviews with PT Perusahaan Listrik Negara UP3 Cikupa Tangerang Regency, secondary data sourced from laws, official documents, and books related to the object of research. Data collection techniques use literature research and field research in the form of direct interviews. As well as data analysis using normative qualitative analysis using data obtained then analyzed in the form of sentences. Based on research data, there is no responsibility for compensation yet, but the number of consumers who suffered losses amounted to 1,460 complaints. The procedure for implementing compensation by PLN must go through several stages. These stages are in the form of PLN receiving complaints experienced by customers, in the flow of procedures for receiving customer complaints there is no explanation related to technical compensation to consumers.

Berdasarkan Pasal 29 ayat (1) huruf e Undang-Undang Nomor 30 Tahun 2009 Tentang Ketenagalistrikan konsumen dapat meminta ganti rugi apabila mendapatkan kerugian yang terjadi akibat pemadaman listrik sehingga menimbulkan dampak kerugian. Peneliti tertarik menelaah tentang Bagaimana Tanggung Jawab PT. Perusahaan Listrik Negara Terhadap Kerugian Konsumen Rumah Tangga Yang Di Akibatkan Kesalahan Atau Kelalaian Pengoperasian Oleh Pemegang Izin Usaha Penyedia Tenaga Listrik Di Kabupaten Tangerang Berdasarkan Undang-Undang Nomor 30 Tahun 2009 Tentang Ketenagalistrikan? Dan Bagaimana Proses Pelaksanaan Klaim Ganti Rugi Oleh Konsumen Rumah Tangga Pengguna Tenaga Listrik Kepada PT. Perusahaan Listrik Negara Berdasarkan Undang-Undang Nomor 30 Tahun 2009 Tentang Ketenagalistrikan? Penelitian ini menggunakan metode yuridis empiris sosiologis, dengan menggunakan spesifikasi penelitian desikriptif analitis. Menggunakan data primer yang bersumber dari lapangan berupa wawancara kepada PT Perusahaan Listrik Negara UP3 Cikupa Kabupaten Tangerang, data sekunder yang bersumber dari undang-undang, dokumen resmi, dan buku-buku yang berhubungan dengan objek penelitian. Teknik pengumpulan data menggunakan penelitian kepustakaan dan penelitian lapangan berupa wawancara langsung. Serta analisis data menggunakan analisis kualitatif normatif dengan menggunakan data yang diperoleh kemudian di analisis dalam bentuk kalimat. Berdasarkan data penelitian, terkait tanggung jawab terhadap ganti kerugian tersebut belum ada akan tetapi jumlah konsumen yang mengalami kerugian sangat banyak berjumlah 1.460 keluhan. Prosedur pelaksanaan ganti kerugian oleh PLN harus melalui beberapa tahapan. Tahapan-tahapan tersebut berupa pihak PLN menerima keluhan-keluhan yang dialami oleh pelanggan, didalam alur prosedur penerimaan keluhan pelanggan tidak didapatkan penjelasan terkait teknis penggantian kerugian ke konsumen. | |||||||||
