Abstract

The existence of the using criminal law for enforcing health protocols in Indonesia has resulted in several health protocol violators being subject to criminal sanctions instead of administrative sanctions. The problem identification in this study is how the criminal law functions through of punishment to the health protocol offenders and how the sentencing of health protocol violators based on the teory of criminal punishment. The theory used in this research is the theory of criminal law in terms of overcriminalization theory and criminal punishment theory. The method used in this research is normative juridical. The specification of the research used is a type of qualitative research with a statutory approach and a case approach. The data sources used are secondary data sources which are further divided into 3 (three) sections, namely primary, secondary and tertiary legal materials, with data collection techniques using library research. The research results obtained are the placement of criminal law as a means of law enforcement for violating health protocols resulting in punishment becoming primum remmedium so that punishment exceeds it’s three main functions namely the declarative function, the preventive function, and the regulative function, the sentencing of health protocol violators does not achieve the goal of punishment The conclusion is that the application of punishment as a primum remmedium causes overcriminalization, and based on the theory of punishment, the imposition of criminal sanctions is not in following with the purpose of punishment. The advice needs to be more in-depth research related to the design of new policies, and finding solutions to the causes of legal problems that want to be regulated so that the use of criminal sanctions does not become overcriminalization. Enforcement of health protocols should be persuasive and educative as well as increasing equality in enforcing sanctions against violators of health protocols and cooperation between law enforcers and community leaders in establishing discipline in the Covid-19 health protocol.

Additional Information: Terdapatnya penggunaan hukum pidana dalam penegakan protokol kesehatan di Indonesia menjadikan beberapa pelanggar protokol kesehatan dikenakan sanksi pidana bukan sanksi administratif. Identifikasi masalah pada penelitian ini adalah bagaimana fungsi hukum pidana terhadap pemidanaan pelanggar protokol kesehatan dan Bagaimana pemidanaan terhadap pelanggar protokol kesehatan berdasarkan teori pemidanaan. Teori yang digunakan dalam penelitian yaitu teori Hukum Pidana yang ditinjau dari overcriminalization theory dan Teori Pemidanaan. Metode yang digunakan dalam penelitian ini yaitu yuridis normatif. Spesifikasi penelitian yang digunakan adalah jenis penelitian kualitatif dengan pendekatan perundang-undangan dan pendekatan kasus. Sumber data yang digunakan adalah sumber data sekunder yang di dalamnya dibagi lagi menjadi 3 (tiga) bagian, yaitu bahan hukum primer, sekunder, dan tersier, dengan teknik pengumpulan data menggunakan penelitian pustaka. Hasil Penelitian yang didapat yaitu penempatan hukum pidana sebagai sarana penegakan hukum pelanggaran protokol kesehatan mengakibatkan pidana menjadi primum remmedium sehingga pidana melebihi tiga fungsi utamanya yakni fungsi deklaratif, fungsi preventif dan fungsi regulatif, pemidanaan pelanggar protokol kesehatan tidak mencapai tujuan pemidanaan. Kesimpulan diterapkannya pidana sebagai primum remmedium menyebabkan overcrominalization, serta berdasarkan teori pemidanaan pemberian sanksi pidana tidak sesuai dengan tujuan pemidanaan. Saran Perlu adanya penelitian lebih mendalam terkait desain kebijakan yang baru, pencarian solusi terhadap penyebab dari permasalahan hukum yang ingin diatur agar penggunaan sanksi pidana tidak menjadi overcriminalization. Penegakan protokol kesehatan sebaiknya bersifat persuasif dan edukatif serta meningkatkan kesetaraan penegakan sanksi terhadap pelanggar protokol kesehatan dan kerja sama antara penegak hukum dan tokoh masyarakat dalam membentuk disiplin protokol kesehatan Covid-19.
