Abstract
Agriculture represents one of the business sectors with high risks and considerable uncertainties. Sources of these risks and uncertainties include natural environmental factors, particularly climate, natural disasters, and outbreaks of plant-disturbing organisms or socio-economic factors. The Department of Agriculture, as an assisting entity to the Regent in the agricultural domain within Serang Regency, holds a pivotal role in facilitating agricultural insurance fulfillment in the regency. In this context, the researcher is intrigued by examining the Department of Agriculture's role in safeguarding the fulfillment of agricultural insurance? and understanding the factors influencing this protection in Serang Regency?.The theoretical foundations employed in this study encompass the Authority Theory and the Legal Protection Theory. The research methodology employed is juridical-empirical, involving the scrutiny and collection of all information tied to legal realities within the Department of Agriculture in Serang Regency. The data utilized in this study encompass primary legal regulations and primary data sourced from interviews with representatives from the Department of Agriculture in Serang Regency, which are subsequently subject to qualitative descriptive analysis. The findings from this research reveal that the protection concerning the Agricultural Crop Insurance (AUTP) fulfillment in Kabupaten Serang aligns with the laws and regulations stipulated by the Ministry of Agriculture. This mechanism yields positive impacts on farmers in Serang Regency, facilitated by third-party services in policy issuance and premium collection from farmers, with the state-owned enterprise JICA covering claims in instances of crop failure due to floods, droughts, and pest issues. The Department of Agriculture conducts data inventory and follows through with socialization and registration processes, all in compliance with Law Number 19 2013. The researcher suggests further optimization of the role to ensure the execution of Agricultural Crop Insurance (AUTP) activities, thereby precluding any negligence or violation of Standard Operating Procedures (SOP) within the Department of Agriculture in Serang Regency.

| Additional Information: | Pertanian merupakan salah satu jenis usaha yang resiko dan ketidakpastiannya tinggi. Sumber resiko dan ketidak pastian antara lain berasal dari lingkungan alam, terutama iklim, bencana alam, dan eksplosi organisme penganggu tanaman atau lingkungan sosial ekonomi, Dinas Pertanian sebagai unsur pembantu Bupati dalam bidang pertanian di Kabupaten Serang memiliki peranan penting terhadap pemenuha asuransi pertanian di Kabupaten serang. Dalam hal ini peneliti tertarik meneliti tentang bagaimana peran Dinas pertanian dalam perlindungan petani terhadap pemenuhan asuransi pertanian di Kabupaten Serang? dan apa faktor yang mempengaruhi untuk pemenuhan asuransi lahan pertanian dalam perlindungan petani di Kabupaten Serang? Teori yang digunakan dalam penelitian ini adalah Teori Kewenangan dan Teori Perlindungan Hukum. Metode penelitian yang digunakan adalah yuridis empiris dengan melihat dan mengumpulkan semua informasi yang berhubungan dengan kenyataan hukum di dalam Dinas Pertanian Kabupaten Serang. Data yang digunakan dalam penelitian ini berupa hukum primer yaitu peratutan perundang-undangan dan data primer berupa wawancara dengan pihak dari Dinas Pertanian Kabupaten Serang untuk melengkapi data yuridis empiris serta dianalisis secara deskriptif kualitatif. Hasil dari Penelitian ini, diketahui dalam Perlindungan terhaddap Pemenuhan Asuransi Usaha Tani Padi (AUTP) di Kabupaten Serang sudah berjalan sesuai dengan Undang-Undang dan Peraturan Menteri Pertanian, serta memberikan dampak positif bagi petani di Kabupaten Serang menggunakan jasa pihak ketiga Menerbitkan polis dan menagih premi ke petani dan BUMN perusahaan JICA membayar klaim jika terjadi gagal panen karena banjir, kekeringan dan OPT, Dinas Pertanian melakukan pendataan/inventarisasi kemudian melakukan sosialisasi dan pendaftaran, terlaksana sesuai dengan Undang-Undang Nomor 19 Tahun 20013. Saran Peneliti lebih mengoptimalkan peran dalam menjalankan kegiatan Asuransi Usaha Tani Padi (AUTP) agar tidak ada pihak-pihak yang mengabaikan ataupun melanggar Standar Operasional Prosedur (SOP) dalam Dinas Pertanian Kabupaten Serang | |||||||||
