Abstract
In cases of inheritance, it often happens that inherited assets that have not been distributed are sold by the heirs where the other heirs do not allow the sale of the assets, so this often causes problems. Therefore, identify the problem of this research, namely regarding the legal provisions for buying and selling inherited assets without the consent of other heirs, as well as the legal consequences of buying and selling inherited assets. The theory used in this research is the theory of justice and legal certainty. Then this research uses analytical descriptive with a normative juridical approach. To collect data, field research was carried out using interviews. The data obtained was analyzed qualitatively, after processing it was then analyzed in a normative juridical manner using deductive and inductive methods and connecting it with applicable laws and regulations. The legal provisions of buying and selling inheritance are carried out without the consent of other heirs, the sale and purchase is considered invalid and the sale and purchase is considered void. This is in accordance with the Word of Allah SWT in Surah An-Nisa' verse 29. The legal consequences of selling inherited property without the consent of other heirs according to Islamic law, this act is considered a false act, because there is a fear that it will take away someone else's share or rights. The people in Cipedang village, Cipedang Village, should comply more with the legal rules for buying and selling land and understand more about legal land buying and selling according to the applicable legal provisions, namely Islamic law.

| Additional Information: | Dalam kasus pewarisan sering terjadi harta waris yang belum dibagikan dijual oleh ahli waris dimana para ahli waris lain tidak mengizinkan penjualan harta tersebut, sehingga hal tersebut sering menimbulkan suatu permasalahan. Oleh karena itu, identifikasi masalah dari penelitian ini yaitu mengenai ketentuan hukum jual beli harta warisan tanpa persetujuan ahli waris lain, serta akibat hukum terhadap jual beli harta warisan tersebut. Teori yang digunakan dalam penelitian ini yaitu teori keadilan dan kepastian hukum. Lalu penelitian ini menggunakan deskriptif analitis dengan pendekatan yuridis normatif. Untuk menghimpun data dilakukan dengan penelitian lapangan dengan menggunakan wawancara. Data yang diperoleh dianalisis secara kualitatif, setelah diolah kemudian dianalisis secara yuridis normatif dengan menggunakan metode deduktif dan induktif serta menghubungkannya dengan peraturan perundang-undangan yang berlaku. Ketentuan hukum jual beli warisan yang dilakukan tanpa persetujuan ahli waris lain maka jual beli tersebut dianggap tidak sah dan jual beli tersebut dianggap batal. Hal ini sesuai dengan Firman Allah SWT pada surat An-Nisa' ayat 29. Akibat hukum dari menjual harta warisan tanpa persetujuan ahli waris lain menurut hukum Islam, perbuatan tersebut termasuk kedalam perbuatan bathil, karena dikhawatirkan akan mengambil bagian atau hak orang lain. Kepada masyarakat yang ada di kampung Cipedang Desa Cipedang hendaknya lebih mematuhi aturan hukum jual beli tanah dan lebih memahami tentang jual beli tanah yang sah menurut ketentuan hukum yang berlaku yaitu hukum Islam. | |||||||||
