Abstract

Legal consideration from the judge‘s case obtain some legal validity of the Right to Ownership Certificate which is used as collateral. Issue of the Right to Ownership Certificate as collateral can be seen according as a valid object that linked to the existence of an agreement that binds the parties in accordance with the principal points of the agreement that have been agreed and adjusted between the value of the collateral and the loan. Identify problems in the explanation of the research are: First, What are the legal issue validity of the certificate guarantee and how to guarantee the debtor's to the creditor from the Tangerang District Court Decision No. 1026/Pdt.G/2018/PN.Tng?; Second, What are the judge's consideration of the case in the agreement guarantee as certificate of ownership of land in the Tangerang District Court decision No.: 1026/Pdt.G/2018/PN.Tng?. Theory that used state of this research is the theory of legal certainty. This research uses normative juridical methods. The data source used in this research is econdary data which is supported by primary data, namely case studies which are then analyzed qualitatively. From the results of this research, conclusions can be drawn, firstly referring to Article 1754 of the Civil Code which in essence if someone owes a debt must be paid with the same type of debt and Right to Ownership Certificate cannot be owned or become the creditor's property because the amount of money lent does not correspond to the value of the house; secondly, considerations the judge regarding the default in the agreement with the guarantee of the land title certificate in the Tangerang District Court decision No.:1026/Pdt.G/2018/PN.Tng has been adjusted to refer to the main points of consideration of the judge regarding the judge's decision which is in accordance with the case of default that occurred between This is caused by the creditor and the debtor because the lawsuit has been decided by the judge to be fair and wise. and has been adjusted according to the applicable provisions in accordance with the case study in the decision, there is also the judge's consideration which can be related to its suitability for the development of similar cases in the future.

Additional Information: Dasar pertimbangan hukum hakim dalam perkara wanprestasi menjelaskan mengenai keabsahan hukum terhadap SHM yang dijadikan jaminan. Keabsahan SHM dalam hukum jaminan dapat dipandang sebagai suatu objek yang sah apabila dikaitkan dengan adanya sebuah perjanjian yang mengikatkan para pihak sesuai dengan pokok-pokok pengikatan yang telah disepakati serta disesuaikan antara nilai jaminan dengan pinjamanya. Identifikasi masalah dalam penelitian ini, pertama bagaimana keabsahan hukum jaminan sertifikat dan guna menjamin utang debitur kepada kreditur dalam Putusan Pengadilan Negeri Tangerang No. 1026/Pdt.G/2018/PN.Tng?; kedua Apakah pertimbangan hakim atas wanprestasi dalam perjanjian dengan jaminan sertifikat hak milik atas tanah pada putusan PN Tangerang No.:1026/Pdt.G/2018/PN.Tng? Teori yang digunakan dalam penelitian ini adalah teori kepastian hukum. Penelitian ini menggunakan metode yuridis normatif. Sumber data yang digunakan dalam penelitian ini adalah data sekunder yang di dukung oleh data primer yaitu studi kasus yang kemudian dianalisi secara kualitatif. Dari hasil penelitian ini dapat diperoleh kesimpulan, pertama Merujuk Pasal 1754 KUHPerdata yang pada intinya apabila sesorang berutang harus dibayar dengan utang yang sama jenisnya dan SHM tidak dapat dimiliki atau menjadi hak milik kreditur karena jumlah uang yang dipinjamkan tidak sesuai dengan nilai bangunan rumah;kedua pertimbangan hakim atas wanprestasi dalam perjanjian dengan jaminan sertifikat hak milik tanah pada putusan PN Tangerang No.: 1026/Pdt.G/2018/PN.Tng telah disesuaikan merujuk pada pokok-pokok pertimbangan hakim terhadap putusan hakim tersebut telah sesuai dengan kasus wanprestasi yang terjadi antara pihak kreditur dengan pihak debitur hal tersebut disebabkan oleh gugatan yang telah diputuskan hakim telah adil dan bijaksana. serta telah disesuaikan menurut ketentuan yang berlaku sesuai dengan studi kasus dalam putusan tersebut, adapula pertimbangan hakim tersebut dapat dikaikatkan kesesuaianya terhadap perkembangan kasus serupa dimasa mendatang.
