Abstract

This research aims to identify the implementation of Article 3 PP No. 56 of 2021 concerning Management of Song & Music Copyright Royalties in the scope of live music cafes both in terms of socialization of regulations, cafe management's understanding of these regulations, as well as implementation of royalty payments to creators of works. Using qualitative approach with descriptive analysis methods, data collection was carried by interviews, observation and documentation. Results of this research found that the cafes who researchers visited had never made royalty payments because they didn't know the regulations regarding music royalties, the existence of LMKN as a royalty collection institution & the concept of royalties itself. Apart from that, implementation of laws has not been carried out optimally in scope of cafe commercial because the type of music performance has not been identified. In order to solve this problem, LMKN, as the attractor and coordinator of music royalties in Indonesia, is intensifying outreach activities to various commercial activity areas, including cafes. The conclusion obtained that LMKN is not widely known by many parties and the forms of socialization that carried out by LMKN have not been distributed across all areas of commercial activity in Indonesia

Additional Information:	Penelitian ini bertujuan untuk mengidentifikasi implementasi Pasal 3 PP No 56 Tahun 2021 Tentang Pengelolaan Royalti Hak Cipta Lagu & Musik pada lingkup kafe-kafe live musik baik dari segi sosialisasi peraturan, pemahaman manajemen kafe terhadap peraturan tersebut, serta implementasi pembayaran royalti kepada pemilik atau pencipta karya musiknya. Digunakannya pendekatan kualitatif dengan metode analisis deskriptif, pengumpulan datanya dilakukan dengan wawancara, observasi, dan dokumentasi. Hasil penelitian menemukan bahwa kafe-kafe yang peneliti datangi di wilayah Kabupaten Tangerang, dan Kota Tangerang Selatan belum pernah melakukan pembayaran royalti karena ketidaktahuan mereka terhadap peraturan perundang-undangan soal royalti musik, keberadaan LMKN sebagai lembaga penarik royalti di Indonesia hingga konsep royalti itu sendiri. Selain itu karena belum teridentifikasinya jenis penayangan atau pertunjukan musik di kafe dengan jelas membuat implementasi Pasal 3 PP No 56 Tahun 2021 belum terlaksana secara maksimal pada lingkup kegiatan komersil kafe/restoran. Guna menyelesaikan permasalahan ini LMKN selaku lembaga penarik dan koordinator royalti musik di Indonesia memasifkan kegiatan sosialisasi kepada berbagai lingkup kegiatan komersil meliputi kafe atau restoran. Kesimpulan yang didapatkan bahwa LMKN sebagai lembaga penarik royalti keberadaannya belum banyak diketahui oleh banyak pihak serta bentuk sosialisasi yang telah dilakukan LMKN belum merata ke seluruh bidang kegiatan komersiil di Indonesia
