Abstract

The rejection of BPJS PBI patients in hospitals has become one of the problems that occur in public health life in Indonesia. Firm and real legal protection is needed to prevent the rejection of BPJS PBI patients in the future. The problem identification in this study is how the legal protection of BPJS PBI patients if they experience rejection at Cibinong Hospital based on Law Number 24 of 2011 concerning BPJS Health and Presidential Regulation Number 12 of 2013 concerning Health Insurance and how legal settlement efforts in the problem of BPJS PBI patient rejection at Cibinong Hospital. The theories used in this research are legal protection theory and legal justice theory. Using qualitative research methods with empirical normative research specifications, data collection techniques using interviews and observation techniques at BPJS Health Cibinong, Bogor Regency Health Office, and Cibinong Hospital. The results showed a mismatch of legal protection against BPJS PBI patients in the hospital because of the refusal of services provided for BPJS PBI participants. The settlement efforts made should be able to provide rights and obligations for BPJS PBI patients to obtain health facilities because all Indonesian citizens have the right to obtain health services and the state is obliged to provide them. The conclusion is that legal protection against BPJS PBI patient rejection still experiences obstacles such as violations of rights and obligations as citizens in obtaining health services for themselves. The researcher's suggestion is that BPJS Health and Cibinong Regional Hospital must carry out and protect all BPJS PBI users in obtaining proper health facilities both in hospitals and puskemas. The BPJS PBI program must be used with the right target that refers to the poor and the poor whose entire financing is paid by the government.

Additional Information:	Penolakan Pasien BPJS PBI di rumah sakit sudah menjadi salah satu masalah yang terjadi pada kehidupan kesehatan masyarakat di Indonesia. Diperlukan perlindungan hukum secara tegas dan nyata guna pencegahan terjadinya penolakan pasien BPJS PBI ke depannya. Identifikasi masalah pada penelitian ini adalah bagaimana perlindungan hukum terhadap pasien pengguna BPJS PBI jika mengalami penolakan di RSUD Cibinong berdasarkan Undang-Undang Nomor 24 Tahun 2011 Tentang BPJS Kesehatan dan Peraturan Presiden Nomor 12 Tahun 2013 Tentang Jaminan Kesehatan dan bagaimana upaya penyelesaian hukum dalam permasalahan penolakan pasien BPJS PBI di RSUD Cibinong. Teori yang digunakan dalam penelitian ini yaitu teori perlindungan hukum dan teori keadilan hukum. Menggunakan metode penelitian kualitatif dengan spesifikasi penelitian normatif empiris, teknik pengumpulan data dengan menggunakan teknik wawancara dan observasi di BPJS Kesehatan Cibinong, Dinas Kesehatan Kabupaten Bogor, dan RSUD Cibinong. Hasil penelitian menunjukkan ketidaksesuain perlindungan hukum terhadap pasien BPJS PBI di rumah sakit karena adanya penolakan pelayanan yang diberikan untuk peserta BPJS PBI. Upaya penyelesaian yang dilakukan seharusnya bisa memberikan hak dan kewajiban bagi pasien BPJS PBI untuk mendapatkan fasilitas kesehatan karena seluruh warga negara Indonesia berhak memperoleh pelayanan kesehatan dan negara wajib untuk menyediakannya. Kesimpulan bahwa perlindungan hukum terhadap penolakan pasien BPJS PBI masih mengalami kendala seperti adanya pelanggaran pada hak-hak serta kewajiban sebagai warga negara dalam memperoleh pelayanan kesehatan bagi dirinya. Saran peneliti yaitu BPJS Kesehatan maupun RSUD Cibinong haruslah menjalankan serta melindungi seluruh pengguna BPJS PBI dalam mendapatkan fasilitas kesehatan yang layak baik di rumah sakit maupun puskemas. Program BPJS PBI harus digunakan dengan tepat sasaran yang merujuk pada orang tidak mampu dan fakir miskin yang seluruh pembiayaan dibayarkan oleh pemerintah.
