Abstract

Theft with violence (robber) is a crime that is disturbing the public, especially during the pancemic Covid-19 because the action tend to hurt the victim. Various regulations have been made during the pandemic Covid-19, but during the pandemic Covid-19 violent theft (robber) has increased so this is of particular concern. The identification of the problem in this thesis is how to enforce criminal law against perpetrators of criminal acts of violent theft (robber) during the pancemic Covid-19 which occurred in the jurisdiction of the South Tangerang Police and what factors caused violent theft (robber) to occur in the area. South Tangerang Police law. The theories used are law enforcement theory and differential association. The research method used is normative juridical. The specifications of this research were carried out using a case approach. The data sources used are secondary data sources consisting of primary, secondary and tertiary legal materials. The results of this research show that law enforcement carried out by the South Tangerang Police during the pandemic Covid-19 was carried out by carrying out pre-emptive, preventive and repressive efforts. During the pandemic Covid-19, the South Tangerang Police continued to use Article 365 of the Criminal Code to ensnare perpetrators of theft with violence (robbery). Then the factors that cause perpetrators to commit criminal acts of theft with violence (robberl) are caused by the learning carried out by perpetrators in intimate/close groups, they lose the supervision of parents and educators in looking after and guiding children during the pandemic Covid-19. The suggestions in this research are that researchers hope that people will be more careful and avoid roads that are prone to burglary. As well as for parents to be able to monitor their children's interactions and for the South Tangerang Police, it is necessary to put up special billboards for the crime of theft with violence (robber) complete with telephone numbers to make it easier if there is a security disturbance around the jurisdiction of the South Tangerang Police.

Additional Information: Pencurian dengan kekerasan (begal) merupakan salah satu tindak pidana yang meresahkan masyarakat terkhusus di masa pandemi Covid-19 karena perbuatannya yang cenderung melukai korban. Berbagai aturan telah dibuat selama pandemi Covid-19 namun di masa pandemi Covid-19 pencurian dengan kekerasan (begal) mengalami peningkatan sehingga hal ini menjadi perhatian khusus. Identifikasi masalah dalam skripsi ini adalah bagaimana penegakan hukum pidana terhadap pelaku tindak pidana pencurian dengan kekerasan (begal) di masa pandemi Covid19 yang terjadi di wilayah hukum Polres Tangerang Selatan dan faktor-faktor apa saja yang menjadi penyebab terjadinya pencurian dengan kekerasan (begal) di wilayah hukum Polres Tangerang Selatan. Teori yang digunakan yaitu teori penegakan hukum dan differential association. Metode penelitian yang digunakan yuridis normatif. Spesifikasi penelitian ini dilakukan dengan pendekatan kasus (case approach). Sumber data yang digunakan sumber data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Hasil dalam penelitian ini bahwa penegakan hukum yang dilakukan oleh Polres Tangerang Selatan di masa pandemi Covid-19 dilakukan dengan melakukan upaya pre-emtif, preventif dan represif, di masa pandemi Covid-19 Kepolisian Polres Tangerang Selatan tetap menggunakan Pasal 365 KUHP untuk menjerat pelaku pencurian dengan kekerasan (begal). Kemudian faktor yang menjadi penyebab pelaku melakukan tindak pidana pencurian dengan kekerasan (begal) ini disebabkan oleh pembelajaran yang dilakukan oleh pelaku dalam kelompok yang intim/dekat, mereka kehilangan pengawasan orang tua serta tenaga pendidik dalam menjaga serta membimbing anak selama pandemi Covid-19. Saran dalam penelitian ini peneliti berharap masyarakat lebih berhati-hati dan menghindari jalan yang rawan aksi pembegalan. Serta untuk para orang tua agar dapat mengawasi pergaulan anak dan bagi kepolisian Polres Tangerang Selatan perlu untuk memasang baliho khusus kejahata pencurian dengan kekerasan (begal) yang lengkap dengan nomor telepon untuk memudahkan jika terjadi gangguan keamanan di sekitaran wilayah hukum Polres Tangerang Selatan.
