Abstract

Among many marriage systems, Baduy has a law and marriage system based on pikukuh which is sourced from Sunda Wiwitan belief although in practice, there are some differences between the marriage of Baduy Dalam and Baduy Luar. Nonetheless problem identification raised in this research includes how the Pikukuh of Baduy Dalam and Baduy Luar Marriage is regulated in Customary Law, Compilation of Islamic Law, and Law Number 16 of 2019 Amendment to Law Number 1 of 1974 concerning Marriage? and what are the differences in the marriage system between Baduy Dalam and Baduy Luar? This research uses the Theory of Comparative Law and Legal Pluralism and the methods used include normative and empirical juridical methods with qualitative research types and secondary data sources through literature studies and interviews with local traditional leaders. The findings in this study include the rules of marriage registration in Baduy Luar which are in line with the Compilation of Islamic Law and Law Number 16 of 2019 Amendment to Law Number 1 of 1974 concerning Marriage and then regarding the marriage system of Baduy community which adheres to endogamy system by marrying only with one clan or one tribe and not allowed to marry with other clans or tribes. The conclusion of this research is that although the Baduy Dalam and Baduy Luar generally follow their own customary laws, elements from the Compilation of Islamic Law and the Marriage Law are also relevant in terms of legal validity and also legal protection. The suggestion of this research is that the government facilitates the making of legislation in which Baduy customary law becomes a legal rule and is systematically harmonized in the eyes of national law so that there is a guarantee of fair legal certainty.

Sehingga identifikasi masalah yang diangkat dalam penelitian ini meliputi bagaimana Pikukuh Perkawinan Baduy Dalam dan Baduy Luar diatur dalam Hukum Adat, Kompilasi Hukum Islam, dan Undang-Undang Nomor 16 Tahun 2019 Perubahan Atas Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan? dan apakah perbedaan sistem perkawinan antara Baduy Dalam dan Baduy Luar? Penelitian ini menggunakan Teori Perbandingan Hukum dan Pluralisme Hukum serta metode yang digunakan meliputi metode yuridis normatif dan empiris dengan jenis penelitian kualitatif dan sumber data sekunder melalui studi kepustakaan dan wawancara dengan tokoh adat setempat. Adapun temuan dalam penelitian ini diantaranya terdapat aturan pencatatan perkawinan pada Baduy Luar yang sejalan dengan Kompilasi Hukum Islam dan Undang-Undang Nomor 16 Tahun 2019 Perubahan Atas Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan kemudian mengenai sistem perkawinan masyarakat Baduy yang menganut sistem endogami dengan perkawinan hanya dilakukan dengan satu klan atau satu suku dan tidak diperbolehkan melakukan pernikahan dengan klan atau suku lain. Kesimpulan dari penelitian ini yaitu meskipun Baduy Dalam dan Baduy Luar secara umum mengikuti hukum adat mereka sendiri, elemen-elemen dari Kompilasi Hukum Islam dan Undang-Undang Perkawinan juga relevan dalam hal validitas hukum dan juga perlindungan hukum. Adapun saran dari penelitian ini yaitu pemerintah memfasilitasi untuk pembuatan peraturan perundang-undang yang dimana pikukuh adat Baduy menjadi aturan yang sah dan terharmonisasi secara sistematis di mata hukum nasional sehingga adanya jaminan kepastian hukum yang adil.
