Abstract
Business competition in this era of globalization is very tight especially in the conditions of the 4.0 revolution, therefore in order for home industries to survive in this business competition, namely by having a brand as regulated under Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The identification of problems in the study as follows, Why the owner of the Tenjo Dodol Home Industry has not registered a brand and How is the settlement of obstacles in the implementation of brand registration in the Dodol Home Industry in Tenjo Village. The theory used in this research is the theory of legal compliance and the theory of legal culture. The research method used is empirical juridical method, namely with research specifications, namely regarding community compliance with brand registration in accordance with Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The data sources used are primary data and secondary data using data collection techniques in the form of field studies and library studies and analyzed qualitatively. The results of this study indicate that, the need for awareness of Dodol Home Industry entrepreneurs in Tenjo Village, Tenjo District, Bogor Regency about the importance of Dodol Tenjo brand registration so that obstacles such as lack of information related to brand registration procedures, lack of counseling and socialization from the local government regarding the importance of Intellectual Property Rights (IPR) especially brands to Dodol Tenjo Home Industry entrepreneurs can be overcome. Legal protection of the Dodol Tenjo brand based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications, namely by registering the Dodol Tenjo brand to the Directorate General of Intellectual Property (DJKI) as an effort to protect the law against the Dodol Tenjo brand in Bogor Regency and a form of Tenjo Village community compliance with the laws and regulations that have been made.

Additional Information: | Persaingan bisnis pada era globalisasi ini sangatlah ketat apalagi di kondisi revolusi 4.0 oleh sebab itu agar indutri rumahan agar tetap bisa bertahan dalam persaingan bisnis ini yaitu dengan cara mempunyai merek sebagaimana yang telah diatur berdasarkan Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Identifikasi masalah dalam penelitian sebagai berikut, Mengapa pemilik Home Industry Dodol Tenjo belum mendaftarkan merek dan Bagaimana penyelesaian terhadap hambatan-hambatan dalam implementasi pendaftaran merek pada Home Industry Dodol dikelurahan Tenjo. Teori yang digunakan dalam penelitian ini yaitu teori kepatuhan hukum dan teori kebudayaan hukum. Metode penelitian yang digunakan adalah metode yuridis empiris yaitu dengan spesifikasi penelitian yaitu mengenai kepatuhan masyarakat terhadap pendaftaran merek sesuai dengan Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Sumber data yang digunakan yaitu data primer dan data sekunder dengan menggunakan teknik pengumpulan data berupa studi lapangan dan studi kepustakan serta dianalisis secara analisis kualitatif. Hasil penelitian ini menunjukan bahwa, perlunya kesadaran pengusaha Home Industry Dodol di Kelurahan Tenjo, Kecamatan Tenjo, Kabupaten Bogor tentang pentingnya pendaftaran merek Dodol Tenjo sehingga hambatan-hambatan seperti kurangnya informasi terkait prosedur pendaftaran merek, kurangnya penyuluhan dan sosialisai dari pemerintah daerah mengenai pentingnya Hak Kekayaan Intelektual (HKI) khusunya merek kepada para pengusaha Home Industry Dodol Tenjo dapat teratasi. Perlindungan hukum terhadap merek Dodol Tenjo berdasarkan UndangUndang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis yaitu dengan mendaftarkan merek Dodol Tenjo ke Direktorat Jendral Kekayaan Intelekual (DJKI) sebagai upaya perlindungan hukum terhadap merek Dodol Tenjo dikabupaten Bogor dan bentuk kepatuhan masyarkat Desa Tenjo terhadap peraturan perundang-undangan yang telah dibuat. | |||||||||
