Abstract
The Covid-19 pandemic has almost hit the entire industry, including the property industry, the challenges are even more severe, the property industry is currently facing the challenge of bankruptcy. Bankruptcy is a general confiscation of all the wealth of a bankrupt debtor whose management and settlement are carried out by the curator under the supervision of a supervisory judge. Bankruptcy is a commercial way to get out of debt problems that ensnare a debtor at this time, where the debtor no longer has the ability to pay debts to his creditors because the debtor is in financial difficulties (Financial Distress). In addition, the property development industry is currently experiencing difficulties where the interest in buying property has decreased, as well as the increasing number of other business competitors competing to win sales. The purpose of this research is to find out and understand the legal considerations of judges in the Commercial Court Decision Number 21/PDT.SUS-Pailit/2020/PN.Niaga Jkt.Pst and find out the legal consequences of the bankruptcy decision of PT.Cowell Development Tbk. To achieve the objectives of this study, the authors conducted descriptive research. The type of research used was normative juridical research. The approach method used is the statutory approach and the case approach. Data collection techniques were carried out through document studies or literature studies and were analyzed using qualitative methods, namely all secondary data obtained were analyzed without using mathematical models and statistical formulas. Based on the research results, it can be seen that in the judge's legal considerations, deciding bankruptcy with all the legal consequences for PT. Cowell development because the bankrupt debtor has two creditors, and the bankruptcy respondent does not pay off at least one debt to one of his creditors, and the debt is due and collectible. The legal consequences of the bankruptcy decision of PT. Cowell Development Tbk, among others, the appointment of a team of curators and management by a panel of judges so that the bankruptcy respondent loses authority over his assets. Therefore, the debtor's assets enter the bankrupt bank for general confiscation.

| Additional Information: | Pandemic Covid-19 hampir memukul seluruh industri tidak terkecuali industri property, tantangan semakin lebih berat lagi industri property pada saat ini menghadapi tantangan kepailitan, Kepailitan adalah sita umum atas semua kekayaan debitor pailit yang pengurusan dan pemberesannya dilakukan oleh kurator dibawah pengawasan hakim pengawas. Kepailitan merupakan salah satu cara yang bersifat komersial untuk keluar dari persoalan utang piutang yang menjerat seorang debitor pada saat ini, dimana debitor tersebut sudah tidak mampunyai kemampuan lagi untuk membayar utang kepada para kreditornya diakibatkan karena debitor tersebut berada dalam kesulitan kondisi keuang (Financial Distress). Ditambah lagi Industri pengembang properti pada saat ini sedang mengalami kesulitan dimana turunnya angka minat pembelian property, serta semakin banyaknya kompetitor bisnis lainnya yang berlomba-lomba memenangkan penjualan. Tujuan dari Penelitian ini adalah untuk mengetahui dan memahami pertimbangan hukum hakim dalam Putusan Pengadilan Niaga Nomor 21/PDT.SUS-Pailit/2020/PN.Niaga Jkt.Pst dan mengetahui akibat hukum putusan pailit PT.Cowell Development Tbk. Untuk mencapai tujuan dalam penelitian ini, Penulis melakukan penelitian deskriptif, Jenis penelitian yang digunakan yaitu penelitian yuridis normatif. Metode pendekatan yang digunakan adalah metode pendekatan perundang-undangan dan pendekatan kasus. Teknik pengumpulan data dilakukan melalui studi dokumen atau studi kepustakaan dan dianalisis dengan menggunakan metode kualitatif yaitu seluruh data sekunder yang diperoleh dianalisis tanpa mengunakan model matematik dan rumus statistik. Berdasarkan hasil penelitian, dapat diketahui bahwa dalam pertimbangan hukum hakim, memutus pailit dengan segala akibat hukumnya kepada PT. Cowell development dikarenakan debitor pailit memiliki dua kreditor, serta termohon pailit tidak membayar lunas sedikitnya satu utang kepada salah satu kreditornya, dan utang tersebut telah jatuh tempo dan dapat ditagih. Akibat hukum putusan pailit PT. Cowell Development Tbk, antara lain dianggkatnya tim kurator dan pengurus oleh majelis hakim sehingga termohon pailit kehilangan wewenang atas harta kekayaannya oleh karena itu, harta kekayaan debitor masuk kedalam budel pailit untuk dilakukan sita umum. | |||||||||
