Abstract

ABSTRACT JUDICIAL REVIEW OF THE DIPLOMATIC RELATIONS BETWEEN SENDING AND THE RECEIVING STATE OF THE IMMUNITY WAIVER TO THE DIPLOMATIC AGENT OF THE COUNTRY UNDER THE VIENNA CONVENTION 1961 ON THE LAW OF DIPLOMATIC RELATIONS (A Case Study on Immunity Waiver Against Diplomatic Agent of Malaysia in New Zealand) MAHAR SUWANDARU 1111122146 The relationship between two countries need a Diplomatic agent someone that act as a representative of a country that place in another country. In Vienna Convention 1961, Diplomatic Agent have immunity to do and complete his/her job in the receiving state. Although diplomatic agents already granted with an immunity to the jurisdiction of the courts of the receiving State, the immunity can be uninstalled or removed by the sending State using the demands of the receiving state. The problem is, what are the factors of the receiving State to demand an immunity waiver of the diplomatic agent. And how this case impact the diplomatic relations between the receiving State and the sending State on the action of this immunity waiver to diplomatic agents of the State. Immunity waiver is an efforts to resolve the case of diplomatic agent who commit violations in the receiving State. This study aims to find out what factors requires the receiving country to demand an immunity waiver against diplomatic agent and how it impacts the diplomatic relations of the two state. The method used in this paper is a normative juridical or Literature study and Qualitative Analysis. The results from this study is, there are several factors that can affect the receiving country in demanding immunity waiver such as criticisms and demands of the various sides of the society to the government, The most important factor is a strong desire to maintain good relationship between that two countries, and will improve the diplomatic relations of the two countries where there was some critics, where there was criticism and demands from various sides of the society to the government. Further, it also define the main purpose of the diplomatic immunity to diplomatic agents as in the Opening of Vienna Convention 1961. Dalam Konvensi Wina 1961 dijelaskan Perwakilan Diplomatik diberikan hak kekebalan diplomatik untuk melakukan tugasnya di Negara penerima. Meskipun para pejabat diplomatik diberikan kekebalan terhadap jurisdiksi peradilan Negara penerima, kekebalan tersebut dapat ditanggalkan atau dihapus oleh Negara pengirim atas tuntutan Negara penerima, masalahnya adalah apa saja yang menjadi faktor Negara penerima untuk menuntut penanggalan kekebalan diplomatik dan bagaimana dampak hubungan diplomatik Negara penerima dan Negara pengirim atas tindakan penanggalan kekebalan diplomatik kepada pejabat diplomatik suatu Negara. Penanggalan kekebalan diplomatik merupakan upaya penyelesaian kasus pejabat diplomatik yang melakukan pelanggaran di Negara penerima. Penelitian ini bertujuan untuk mengetahui faktor apa yang mengharuskan Negara penerima dalam menuntut penanggalan kekebalan terhadap perwakilan diplomatik dan bagaimana dampak hubungan diplomatik yang ditimbulkan atas tindakan penanggalan kekebalan kepada pejabat diplomatik suatu Negara. Metode yang digunakan dalam penulisan ini adalah Yuridis Normatif atau studi kepustakaan dan Analisis Kualitatif. Adapun hasil dari penelitian ini adalah terdapat beberapa faktor yang dapat mempengaruhi Negara penerima dalam menuntut penanggalan kekebalan diplomatik antara lain adanya berbagai kritikan dan tuntutan dari berbagai pihak masyarakat kepada pemerintah, faktor yang sangat penting adanya keinginan yang kuat untuk tetap mempertahankan hubungan baik dari kedua Negara dan dampak yang ditimbulkan terhadap hubungan diplomatik kedua Negara justru membaik dimana sebelumnya terjadi kritik dan tuntutan dari berbagai pihak masyarakat kepada pemerintah, Hal ini juga lebih menegaskan tujuan yang sebenarnya dari pemberian kekebalan diplomatik kepada para diplomat yang sebagaimana sesuai dalam Pembukaan Konvensi Wina 1961.
