Abstract

The armed conflict between the Taliban and Afghanistan has been going on since 2001 until finally in 2021 the Taliban reoccupied Afghanistan. The United States supplied the Afghan military with the tools to defeat the Taliban, but the rapid fall of Kabul and other major cities had left much of that weaponry in the hands of the Taliban and became War Booty. Based on this, the formulation of the problem in this study is how the status of the means of war as war booty in armed conflict based on the 1907 Hague Convention and whether the Taliban's act of confiscation of American weapons is justified in the 1907 Hague Convention. The research method is normative juridical. with a statutory approach and a conceptual approach then the existing data is analyzed qualitatively. The results show that as long as the loot is movable property belonging to the state that can be used for military operations and not civilian objects, the loot is the property of the military authorities who occupied the area of conflict before there was a peace agreement from the belligerent parties so that the Taliban took action against the target. American military action is still permitted under international humanitarian law and is regulated in the 1907 Hague Convention.

Additional Information:	Konflik bersenjata antara taliban dan Afghanistan telah berlangsung sejak tahun 2001 sampai akhirnya tahun 2021 Taliban menduduki lagi Afghanistan. Amerika Serikat memasok kebutuhan militer Afghanistan dengan alat-alat untuk mengalahkan Taliban, tetapi jatuhnya Kabul dan kota-kota besar lainnya dengan cepat telah meninggalkan sebagian besar persenjataan itu ke tangan para tentara taliban sehingga menjadi War Booty (Rampasan Perang). Berdasarkan hal tersebut rumusan masalah dalam penelitian ini adalah bagaimana status sarana perang sebagai rampasan perang (war booty) dalam konflik bersenjata berdasarkan Konvensi Den Haag 1907 dan Apakah tindakan Taliban melakukan perampasan terhadap senjata milik Amerika dibenarkan dalam Konvensi Den Haag 1907. Metode penelitian yaitu yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual lalu data yang ada di analisis secara kualitatif. Hasil penelitian menunjukkan selama rampasan itu adalah benda-benda bergerak milik negara yang dapat dipergunakan untuk operasi militer dan bukan obyek sipil maka rampasan itu adalah hak milik penguasa militer yang menduduki wilayah pertikaian sebelum ada kesepakatan damai dari pihak yang berperang sehingga tindakan Taliban melakukan perampasan terhadap sasaran militer Amerika adalah tindakan yang masih dibolehkan dalam hukum humaniter Internasional dan diatur dalam Konvensi Den Haag 1907.
