Abstract

Appointment of Acting Regional Heads by the President and Minister of Home Affairs on the legal basis of Law No. 10 of 2016 concerning the Election of Governors, Regents and Mayors which caused problems, and a judicial review was carried out which resulted in MKRI Decision Number 67/PUU-XIX/2021 and MKRI Decision Number 15 /PUUXX/2022, the purpose of this research is to find out whether it is in accordance with legislation and what is the authority? This thesis uses the normative juridical legal research method as the main method and empirical juridical as the supporting method. The data analyzed are primary data and secondary data, the analytical method used is descriptive analysis method on qualitative data through induction, deduction, and interpretation with logical ideas. Based on the research, it was found that the regulation was insufficient and incomplete to be used as a legal basis governing the Appointment and powers of Acting Regional Heads by the President and the Minister of Home Affairs. Additional Information:	Pengangkatan Penjabat Kepala Daerah oleh Presiden dan Mendagri dengan dasar hukum UU No 10 Tahun 2016 tentang Pemilihan Gubernur, Bupati, dan Walikota yang menimbulkan permasalahan, dan telah dilakukan uji materi yang menghasilkan Putusan MKRI Nomor 67/PUU-XIX/2021 dan Putusan MKRI Nomor 15/PUUXX/2022, yang masih belum sesuai dengan semangat demokrasi dan asas-asas umum pemerintahan yang baik, tujuan dari penelitan ini adalah untuk mengetahui apakah sesuai dengan perundang-undangan dan bagaimanakah kewenangannya?. Tesis ini menggunakan metode penelitian hukum yuridis normatif sebagai metode utama dan yuridis empiris sebagai metode pendukung. Data yang dianalisa yakni data primer dan data sekunder, metode analisis yang digunakan yaitu metode analisis deskriptif pada data kualitatif melalui induksi, deduksi, dan interprestasi dengan gagasan yang logis. Berdasarkan penelitiaan diperoleh analisa bahwa pengaturan tersebut belum cukup dan belum lengkap untuk digunakan sebagai dasar hukum yang mengatur mengenai Pengangkatan dan kewenangannya Penjabat Kepala Daerah oleh Presiden dan Menteri dalam Negeri. Kata kunci : Penjabat, Kepala Daerah, Pengangkatan, Kewenangan.
