Abstract

The presence of Law Number 40 of 1999 concerning the Press to realize Press freedom and to provide guarantees of protection for the Press from any intervention in carrying out its role. The Press Council, which is free from government interference, has a strategic role in regulating the pattern of relations between the State and the Press with the main strengthening of the creation of an independent and free Press in carrying out its function as a medium of information, education, entertainment and social control. Aimed at protecting press personnel in carrying out their professional duties the Press Council through Regulation Number: 1/Regulation-DP/II/2010 concerning Journalist Competency Standards as updated by Press Council Regulation Number: 01/Regulation-DP/X/2018 concerning Journalist Competency Standards. But in practice, the Journalist Competency Test (UKW) certification program raises new problems that arise in the life of the Indonesian Press. This research is a type of qualitative research. The research data were obtained from interviews with resource persons and completed with literature study. This study uses a normative juridical approach in analyzing data and is presented in a descriptive analytical manner. The legal materials used in this research are primary and secondary legal materials. The results showed that the journalist competency standard is the ability that journalists must have to understand, master, and enforce the journalistic or journalism profession. As the Press Council competency test certification program runs, until now there are no legal regulations, especially the Press Law, which explicitly state journalist competency standards, so in implementing the Journalist Competency Test (UKW) certification, special rules that are binding are required to run. in accordance with applicable law. Because in carrying out their profession, journalists get a guarantee of protection from the government and / or society in carrying out their functions, rights, obligations and roles in accordance with the provisions of laws and regulations.

Additional Information:	Kehadiran Undang-Undang Nomor 40 Tahun 1999 tentang Pers untuk mewujudkan kemerdekaan Pers dan memberikan jaminan perlindungan bagi Pers dari intervensi apapun dalam melaksanakan perannya. Dewan Pers yang bebas dari campur tangan Pemerintah, memiliki peranan yang strategis dalam mengatur pola hubungan Negara dan Pers dengan penguatan utama terwujudnya Pers yang merdeka dan bebas dalam melaksanakan fungsinya sebagai media informasi, pendidikan, hiburan, dan kontrol sosial. Bertujuan untuk melindungi insan pers dalam menjalankan tugas profesinya Dewan Pers melalui Peraturan Nomor: 1/Peraturan-DP/II/2010 Tentang Standar Kompetensi Wartawan yang diperbaharui dengan Peraturan Dewan Pers Nomor 01/Peraturan-DP/X/2018 tentang Standar Kompetensi Wartawan. Namun pada pelaksanaanya, program sertifikasi Uji Kompetensi Wartawan (UKW) menimbulkan problematika baru yang timbul dalam kehidupan Pers Indonesia. Penelitian ini merupakan jenis penelitian kualitatif. Data penelitian diperoleh dari wawancara dengan narasumber dan dilengkapi dengan studi pustaka. Penelitian ini menggunakan pendekatan yuridis normatif dalam menganalisis data dan disajikan secara deskriptif analitis. Bahan hukum yang digunakan dalam penelitian ini merupakan bahan hukum primer dan bahan hukum sekunder. Hasil penelitian menunjukan bahwa standar kompetensi wartawan merupakan kemampuan yang harus dimiliki wartawan untuk memahami, menguasai, dan menegakkan profesi jurnalistik atau kewartawanan. Seiring berjalannya program sertifikasi uji kompetensi wartawan oleh Dewan Pers hingga saat ini belum ada peraturan hukum khususnya Hukum Pers yang secara eksplisit menyebutkan mengenai standar kompetensi wartawan, maka dalam pelaksanaan sertifikasi Uji Kompetensi Wartawan (UKW) diperlukan aturan khusus yang bersifat mengikat agar berjalan sesuai dengan hukum yang berlaku. Karena dalam melaksanakan profesinya wartawan mendapatkan jaminan perlindungan pemerintah dan atau masyarakat dalam melaksanakan fungsi, hak, kewajiban dan peranannya sesuai dengan ketentuan peraturan perundang-undangan.
