Abstract

Problems with the use of toll road shoulders arise when people who do not obey the rules pick up/drop off passengers on the shoulder of the road and stop on the shoulder of the toll road when it is not an emergency, which creates new problems and can endanger toll road users. Government Regulation Number 15 of 2005 has explained that toll road shoulders are only used in emergency situations. As for identifying the problem, how is the implementation of restrictions on the use of toll road shoulders based on Government Regulation Number 15 of 2005 concerning the Tangerang-Merak Toll Road? So what are the obstacles in implementing restrictions on the use of toll road shoulders based on Government Regulation Number 15 of 2005 concerning the Tangerang-Merak Toll Road? Furthermore, the theories used are authority theory and supervision theory, the research method is empirical juridical. Research specifications are descriptive analysis, data sources are primary data supported by secondary data, data collection techniques are interviews and documents related to research, data is obtained and analyzed descriptively using a qualitative approach method, research results regarding attribution authority are given directly by law -invite the PJR Serang traffic corps so that they can carry out direct supervision to limit the use of the toll road shoulder by carrying out stationary patrols and can find four problem obstacles, namely people who board and descend passengers on the toll road shoulder, lack of public awareness in creating personal safety themselves and other people, trucks parked on the shoulder of the toll road when it is not an emergency, and the lack of direct supervision patrol members so that they are not optimal in carrying out supervision, then the direct supervision and direct inspections carried out by the PJR Serang traffic corps have not run as desired, the conclusion is The PJR Serang traffic corps carries out supervision in accordance with the provisions of the law, but there are still many people who have low self-awareness so they still commit violations on the shoulders of toll roads. Apart from that, the PJR Serang traffic corps also does not take firm action to reduce violations against the public. Those who violate it, the suggestions are the need to strengthen institutions for the PJR Serang traffic corps, the need to increase human resources and facilities on the Tangerang-Merak Toll Road and provide learning to the public regarding the applicable regulations.

Additional Information: Permasalahan penggunaan bahu jalan tol muncul ketika masyarakat yang tidak taat akan aturan melakukan naik/turun penumpang di bahu jalan dan berhenti di bahu jalan tol saat tidak darurat yang menimbulkan masalah baru dan dapat membahayakan pengguna jalan tol. Peraturan Pemerintah Nomor 15 Tahun 2005 sudah dijelaskan bahwa bahu jalan tol hanya digunakan dalam keadaan darurat. Adapun identifikasi masalahnya, bagaimana implementasi pembatasan penggunaan bahu jalan tol berdasarkan Peraturan Pemerintah Nomor 15 Tahun 2005 tentang Jalan Tol Tangerang-Merak? Kemudian apa hambatan dalam penyelenggaraan pembatasan penggunaan bahu jalan tol berdasarkan Peraturan Pemerintah Nomor 15 Tahun 2005 tentang Jalan Tol Tangerang-Merak? Selanjutnya teori yang digunakan adalah teori kewenangan dan teori pengawasan, metode penelitian yaitu yuridis empiris. Spesifikasi penelitian yaitu deskriptif analisis, sumber data yaitu data primer yang ditunjang oleh data sekunder, teknik pengumpulan data adalah wawancara dan dokumen yang terkait dengan penelitian, data diperoleh dan dianalisis secara deskriptif dengan metode pendekatan kualitatif, hasil penelitian mengenai kewenangan atribusi yang diberikan langsung oleh undang-undang kepada Korps lalu lintas PJR Serang sehingga dapat menjalankan pengawasan langsung untuk melakukan pembatasan penggunaan bahu jalan tol dengan cara melakukan patroli stasioner serta dapat menemukan empat hambatan masalah yaitu masyarakat yang melakukan naik turun penumpang di bahu jalan tol, kurangnya kesadaran masyarakat dalam menciptakan kesalamatan diri sendiri dan orang lain, truk yang parkir di bahu jalan tol saat tidak darurat, dan kurangnya anggota patroli pengawasan langsung sehingga tidak maksimal dalam melakukan pengawasan kesimpulannya adalah Korps lalu lintas PJR Serang melakukan pengawasan sesuai dengan atribusi dari undang-undang namun masih banyak masyarakat yang memiliki kesadaran diri yang rendah sehingga masih melakukan pelanggaran di bahu jalan tol selain itu Korps lalu lintas PJR Serang juga kurang melakukan tindakan yang tegas untuk menggurangi pelanggaran terhadap masyarakat yang melanggarnya, sarannya adalah perlunya penguatan kelembagaan untuk Korps lalu lintas PJR Serang, perlunya peningkatan sumber daya manusia dan fasilitas di Jalan Tol Tangerang-Merak dan pemberian pembelajaran kepada masyarakat mengenai aturan yang berlaku.
