Abstract

Traffic accidents are things that are very likely to occur anywhere and anytime and with any factor, as happened in Serang Regency, a Tourist Train had an accident caused by the negligence of the Driver, where a Tourist Train carrying dozens of passengers was hit by a train on the Merak-Rangkasbitung route resulting in the loss of 10 lives in the incident, In this case, the court decided that there was an element of intent by the driver, which was actually not sufficiently proven at the scene of the crime, and there was an element of mitigation in the verdict because of the compensation that was not actually given as a whole, making the author formulate problem identification How is the review of criminal law on cases of accidents that cause loss of life based on Decision Number 708/Pid. Sus/2022/PN Srg? And what is the form of legal protection for victims based on Decision Number 708/Pid.Sus/2022/PN Srg? The research was conducted with theories that support the research, including the theory of legal review and also the theory of legal protection, as well as empirical research methods that the author conducted directly in the field. various kinds of mistakes that occur in the field are factors that make it difficult for defendants to get proper justice. In this research the author found a number of facts in the field that revealed that the incident was not intentional but rather negligent because there were elements outside the driver that could have fatal consequences, one of which was that there was not a single adequate warning sign in the crime scene area. If this is still considered intentional then this is tantamount to tyrannizing over the road users, and even though the judge was of the opinion that the compensation was a mitigation for the defendant, this view is not in line with the provisions in Article 240 letter b of Law No. 22 of 2009 concerning Road Traffic and Transportation. From a legal perspective, providing compensation is not a form of mitigation, but rather a moral and social responsibility. The conclusion that the author reaches is that in this case the defendant should not have been convicted on charges of intentionality because according to what the author observed directly from various sources this was not entirely intentional and the compensation should not be used as a reason for mitigating the charges, Suggestions that can be made by the author are that every law enforcement officer should explore the case properly and comprehensively from a normative and empirical perspective in the field so that a fair verdict can be obtained and ensure legal certainty.

Additional Information: Kecelakaan lalu lintas merupakan hal yang sangat mungkin terjadi dimanapun dan kapanpun dan dengan faktor apapun, seperti yang terjadi di Kabupaten Serang sebuah Kereta Wisata mengalami kecelakaan yang disebabkan oleh kelalaian Pengemudi, dimana sebuah Kereta Wisata yang mengangkut puluhan penumpang tertabrak kereta api jurusan Merak-Rangkasbitung sehingga hilangnya 10 nyawa dalam peristiwa tersebut, dalam perkara ini pengadilan memutuskan bahwa adanya unsur kesengajaan oleh pengemudi yang sebetulnya hal tersebut tidak cukup terbukti dalam TKP serta adanya unsur peringan dalam putusan karena adanya santunan yang sebetulnya tidak diberikan secara menyeluruh, membuat penulis merumuskan identifikasi masalah Bagaimana tinjauan hukum pidana terhadap kasus kecelakaan yang menyebabkan hilangnya nyawa berdasarkan Putusan Nomor 708/Pid.Sus/2022/PN Srg? Dan Bagaimana bentuk perlindungan hukum kepada korban berdasarkan Putusan Nomor 708/Pid.Sus/2022/PN Srg? Penelitian dilakukan dengan teori-teori yang mendukung penelitian diantara lain yaitu teori tinjauan hukum dan juga teori perlindungan hukum, serta metode Penelitian empiris yang penulis lakukan langsung di lapangan. berbagai macam kekeliruan yang terjadi di lapangan yang menjadi faktor-faktor yang membuat terdakwa sulit mendapatkan keadilan yang semestinya. Pada penelitian ini penulis mendapati sejumlah fakta di lapangan yang mengungkap bahwasannya Pristiwa tersebut bukanlah sebuah kesengajaan melainkan sebuah Kelalaian karena ada unsur di luar pengemudi yang dapat berakibat fatal salah satunya tidak ada satupun rambu peringatan yang memadai di area TKP jika hal tersebut tetap dianggap sebuah kesengajaan maka hal ini sama saja mendzalimi masyarakat pengguna jalan, dan meskipun hakim berpendapat bahwa santunan tersebut merupakan peringan bagi terdakwa, pandangan ini tidak selaras dengan ketentuan yang ada dalam Pasal 240 huruf b Undang-Undang No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Pada perspektif hukum, pemberian santunan bukanlah bentuk peringan, melainkan tanggung jawab moral dan sosial. Kesimpulan yang penulis peroleh yaitu dalam perkara ini terdakwa tidak seharusnya dihukum dengan dakwaan kesengajaan karena sesuai dengan apa yang penulis amati secara langsung dari berbagai sumber hal tersebut tidak sepenuhnya merupakan sebuah kesengajaan dan Adapun santunan/atau ganti rugi tidak seharusnya dijadikan alasan peringan tuntutan, Saran yang bisa penulis utarakan yaitu bagi setiap aparatur penegak hukum seharusnya lebih mendalami kasus dengan baik dan komperhensif secara menyeluruh dari segi normatif dan juga empiris di lapangan sehingga bisa didapat Putusan yang adil serta menjamin kepastian hukum.
