Abstract
Informed consent is not just a formality of a medical approval sheet, but the basis of evidence that there has been a communication between the doctor and the patient until finally the patient gives consent to accept or refuse medical action. Surgery can only be performed after obtaining written consent which is documented and completed in an informed consent sheet. The purpose of this research is to analyze the application of informed consent for surgery in RSUD Berkah Pandeglang related to the completeness of informed consent recording, as well as legal protection against doctors in informed consent for surgery. The method used is normative juridical and empirical juridical, while the data analysis is done in qualitative descriptive based on interview data with 4 specialist doctors, 2 nurses, 2 patients, 2 patients' families, and the head of medical services of RSUD Berkah Pandeglang. The result of this research is the process of informed consent implementation in RSUD Berkah Pandeglang has been largely in accordance with the legislation, but there are still some things that must be improved in order to record and complete the informed consent sheet before surgery, including the availability of informed consent sheet in polyclinic, compliance of operator doctors, and the addition of hospital officers specifically to check the completeness of informed consent.

| Additional Information: | Persetujuan tindakan medis atau informed consent bukanlah formalitas lembar persetujuan medis saja, melainkan dasar bukti telah dilakukannya suatu komunikasi antara dokter dan pasien hingga akhirnya pasien memberikan persetujuan untuk menerima atau menolak tindakan medis. Tindakan operasi hanya dapat dilakukan setelah mendapatkan persetujuan secara tertulis yang didokumentasikan dan dilengkapi dalam lembar informed consent. Tujuan penelitian ini untuk menganalisa penerapan informed consent untuk tindakan operasi di RSUD Berkah Kabupaten Pandeglang terkait dengan kelengkapan pencatatan informed consent, serta perlindungan hukum terhadap dokter dalam informed consent tindakan operasi. Metode yang digunakan yuridis normatif dan yuridis empiris, sedangkan analisis data dilakukan secara deskriktif kualitatif berdasarkan data wawancara dengan 4 dokter spesialis, 2 perawat, 2 pasien, 2 keluarga pasien, dan kepala bidang pelayanan medik RSUD Berkah Pandeglang. Adapun hasil penelitian ini yaitu proses pelaksanaan informed consent di RSUD Berkah Kabupaten Pandeglang secara garis besar telah sesuai dengan peraturan perundang-undangan, namun masih terdapat beberapa hal yang harus diperbaiki dalam rangka pencatatan dan kelengkapan lembar informed consent sebelum tindakan operasi, diantaranya adalah ketersediaan lembar informed consent di poliklinik, kepatuhan dokter operator, dan penambahan petugas rumah sakit yang khusus untuk memeriksa kelengkapan informed consent. | |||||||||
