Abstract

Postponement of Debt Payment Obligations is an alternative institution that can be used to resolve debt problems between debtors and their creditors other than bankruptcy. A PKPU application is submitted by a debtor who has more than 1 (one) creditor or by a creditor to the commercial court. PKPU cases that cannot be proven simply will be rejected by the Judge, such as the PKPU application of PT Garuda Indonesia (PERSERO) Tbk with My Indo Airlines as stated in this article. Identification of the problem in this research is: How is simple evidentiary in postponing debt payment obligations related to the suitability of the application of legal provisions in the PKPU Garuda Indonesia (Persero) Tbk case related to Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations?, and what are the efforts? legal protection for the judge's consideration of rejecting the PKPU and concurrent creditor requests in Decision Number 289/Pdt.Sus-PKPU/2021/PN Niaga Jkt.Pst?. The theories used in this research are the Theory of Justice and the Theory of Balance. The research method used in writing this thesis is a normative juridical research method which will rely on secondary data and primary data. The results of simple evidentiary research in this research can be proven through the existence of proof of payment that has been paid by the creditor and there are no definite details so there is no legal basis. The material requirements in the PKPU petition are not in accordance with the existing legal facts, because during the trial the judge found a difference in the nominal amount of debt submitted by the PKPU applicant and the evidence provided by the PKPU Respondent. In PKPU cases, in-depth accuracy is required on the part of the applicant in submitting the application documents. It is best to double-check the completeness and correctness of the files before submitting the application because the lack of even one requirement can result in the PKPU application not being accepted.

Additional Information:	Penundaan Kewajiban Pembayaran Utang merupakan Lembaga alternatif yang dapat digunakan sebagai penyelesaian permasalahan utang-piutang antar debitor dengan para kreditornya selain kepailitan. Permohonan PKPU diajukan oleh debitor yang mempunyai lebih dari 1 (satu) kreditor atau oleh kreditor ke pengadilan niaga. Perkara PKPU yang tidak dapat dibuktikan secara sederhana akan ditolak oleh Hakim seperti pada permohonan PKPU PT Garuda Indonesia (PERSERO) Tbk dengan My Indo Airlines seperti yang terdapat dalam penulisan ini. Identifkasi masalah dalam penelitian ini yaitu Bagaimana mengenai Pembuktian Sederhana dalam Penundaan Kewajiban Pembayaran Utang terkait kesesuaian penerapan ketentuan hukum dalam perkara PKPU Garuda Indonesia (Persero) Tbk dihubungkan dengan Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang?, dan Bagaimana upaya perlindungan hukum terhadap pertimbangan hakim yang menolak permohonan PKPU dan kreditur konkuren dalam Putusan Nomor 289/Pdt.Sus-PKPU/2021/PN Niaga Jkt.Pst?. Teori yang digunakan dalam penelitian ini adalah Teori Keadilan dan Teori Keseimbangan, Metode Penelitian yang digunakan dalam penulisan skripsi ini adalah metode penelitian yuridis normatif yang akan bertumpu pada data sekunder dan data primer. Hasil penelitian pembuktian sederhana dalam penelitian ini dapat dibuktikan melalui adanya bukti bukti pembayaran yang telah dibayarkan oleh kreditur dan tidak ada rincian pasti sehingga tidak beralasan hukum. Syarat materiil dalam permohonan PKPU tidak sesuai dengan fakta hukum yang ada, karena dalam persidangan hakim menemukan perbedaan jumlah nominal utang yang diajukan pemohon PKPU dengan bukti-bukti yang diberikan Termohon PKPU. Pada perkara PKPU dibutuhkan ketelitian yang mendalam baik dari pihak Pemohon dalam mengajukan berkas permohonan, sebaiknya memeriksa kembali kelengkapan dan kebenaran berkas sebelum mengajukan permohonan karena kekurangan satu syarat saja dapat mengakibatkan permohonanPKPU tidak diterima.
