Abstract

In Indonesia, where the majority of the population is Muslim, it is necessary to protect consumers from circulating products. There are still many products circulating in the community that are not guaranteed to be halal. Until now, Ai- CHA ice cream products do not have halal certification, even though the government has issued mandatory regulations for halal certification for businesses. Identification of the problem, namely, how to enforce legal protection for consumers against the obligation of halal certification for Ai-CHA ice cream product business actors, and what factors cause Ai-CHA ice cream products not to have halal certificates. The theory used by the author is the theory of legal protection and legal certainty as a reference. The research method used is normative empirical, case study research specifications. The data sources are secondary data and primary data, with interview collection techniques and data analysis used is descriptive qualitative. The results of this study state that the implementation of legal protection for consumers against the obligation of halal certification for business entities is not carried out based on Article 4 UUJPH, Article 2 paragraph (1) of the current JPH Food PP. This is because the obligations that should have been carried out by Ai-CHA business actors to register halal certification were not carried out. Enforcement of consumer rights of the nine rights accommodated in Article 4 UUPK there are six points that are fulfilled and three points that are not fulfilled. As for the non-fulfillment of these points because there are underlying problems, namely the obligation of halal certification. The suggestion is that the government should increase good cooperation between authorized institutions in requiring halal product certification for business actors. Therefore, controlling the distribution of ice cream and other processed products that are not halal-certified can result in punitive actions against business actors. In addition, it also conducts outreach to business actors so that they are aware of the importance of providing halal certification for products to ensure safety and protect consumers before they are marketed.

Additional Information:	Di Indonesia dengan mayoritas penduduk beragama muslim perlu perlindungan konsumen terhadap produk yang beredar. Masih banyak produk yang beredar di masyarakat belum terjamin kehalalannya. Produk es krim Ai-CHA sampai saat ini juga belum memiliki sertifikasi halal, padahal pemerintah sudah memberikan aturan kewajiban sertifikasi halal bagi pelaku usaha. Identifikasi masalah yaitu, bagaimana penegakan perlindungan hukum bagi konsumen terhadap kewajiban sertifikasi halal pelaku usaha produk es krim Ai-CHA, serta faktor-faktor apa yang menyebabkan produk es krim Ai-CHA belum memiliki sertifikat halal. Teori yang digunakan penulis adalah teori perlindungan hukum dan kepastian ini hukum sebagai acuan. Metode penelitian yang digunakan normatif empiris, spesifikasi penelitian studi kasus. Sumber datanya yaitu data sekunder dan data primer, dengan teknik pengumpulan wawancara serta analisis data yang digunakan yaitu deskriptif kualitatif. Hasil penelitian ini menyatakan bahwa penerapan perlindungan hukum terhadap konsumen terhadap kewajiban sertifikasi halal bagi badan usaha tidak dilakukan berdasarkan Pasal 4 UUJPH, Pasal 2 ayat (1) PP Pangan Bidang JPH saat ini. Hal ini dikarenakan kewajiban yang seharusnya dilakukan pelaku usaha Ai- CHA untuk mendaftarkan sertifikasi halal tidak dilaksanakan. Penegakan hak-hak konsumen dari sembilan hak yang diakomodir dalam Pasal 4 UUPK terdapat enam poin yang terpenuhi dan tiga poin yang tidak terpenuhi. Adapun tidak terpenuhinya poin tersebut karena terdapat permasalahan yang mendasarinya, yaitu kewajiban sertifikasi halal. Sebagai saran yaitu Pemerintah hendaknya meningkatkan kerja sama yang baik antar lembaga yang berwenang dalam mewajibkan sertifikasi halal produk bagi pelaku usaha. Oleh karena itu, pengendalian peredaran es krim dan produk olahan lainnya yang tidak bersertifikat halal dapat menimbulkan tindakan hukuman terhadap pelaku usaha. Selain itu juga melaksanakan sosialisasi kepada para pelaku usaha agar sadar akan pentingnya pemberian sertifikasi halal terhadap produk guna menjamin keamanan dan melindungi konsumen sebelum dipasarkan.
