Abstract
The case of GOTO versus GoTo can raise issues regarding the standing of the two brands. Especially regarding the rights that should be obtained by the brand owner in the form of exclusive rights which are regulated in Article 3 of the MIG Law and also legal certainty related to the first to file principle. The granting of an application for registration of another mark raises uncertainty regarding the exclusive right and first-to-file principle of the mark. On the other hand, in a trademark dispute in court, the judge wins the newly registered trademark because the lawsuit has run away. Identification of the problem in this study, namely how is legal certainty on the principle of first to file from the case of the GOTO brand against the GoTo brand and how is the legal protection of the rights to the GOTO brand against violations of brand reputation by GoTo based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The theory used is the theory of legal certainty and the theory of justice. The research method used is normative juridical, with a case approach research specification, namely where researchers try to build legal arguments in the perspective of concrete cases that occur in the field. The data sources are secondary data and primary data, with Library Research data collection techniques and data analysis used is descriptive qualitative. The research locations used were the Directorate General of Intellectual Property and Sultan Ageng Tirtayasa University library. The conclusion of this study is that legal certainty from the first to file principle in this case is not in accordance with what should have happened. Because the Directorate General of Intellectual Property believes that the registered GoTo mark is not the same as the previously registered GOTO mark and the legal protection for the GOTO mark in this case has fulfilled the provisions of Article 21 paragraph (1) of Law Number 20 of 2016 concerning Trademarks and Geographical Indications but the terminology of reputation protection in the elucidation of Article 21 letter b does not accommodate all layers of the company. It only protects companies that are legally well known and there are difficult conditions for companies that are still developing their brand just to get reputation protection.

Additional Information: | Kasus GOTO melawan GoTo dapat menimbulkan permasalahan terkait kedudukan kedua merek. Terutama mengenai hak yang seharusnya didapatkan oleh pemilik merek berupa hak ekslusif yang peraturannya ada di Pasal 3 UU MIG dan juga kepastian hukum terkait asas first to file. Dikabulkannya permohonan pendafartaran merek yang lain menimbulkan ketidakpastian mengenai hak eksklusif dan asas first to file dari merek tersebut. Disisi lain, dalam sengketa merek di pengadilan, hakim memenangkan merek yang baru terdaftar karena gugatan kabur. Identifikasi masalah dalam penelitian ini yaitu Bagaimana kepastian hukum atas prinsip first to file dari kasus merek GOTO melawan merek GoTo berdasarkan Undang-undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis? dan bagaimana perlindungan hukum hak atas merek GOTO terhadap pelanggaran reputasi merek oleh GoTo berdasarkan Undang-undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis?. Teori yang digunakan teori kepastian hukum dan teori keadilan. Metode penelitian yang digunakan yaitu Yuridis normatif, dengan spesifikasi penelitian Pendekatan Kasus, yaitu dimana peneliti mencoba membangun argumentasi hukum dalam perspektif kasus konkret yang terjadi di lapangan. Sumber datanya yaitu data sekunder dan data primer, dengan teknik pengumpulan data Library Research serta analisis data yang digunakan yaitu deskriptif kualitatif. Hasil dari penelitian ini bahwa pihak DJKI tetap mempertahankan pendapatnya bahwa merek ini merupakan merek tidak sejenis. Kesimpulan dari penelitian ini yaitu, Kepastian hukum dari asas first to file terhadap kasus ini belum sesuai dengan apa yang seharusnya terjadi. Dikarenakan pihak Direktorat Jenderal Kekayaan Intelektual berpendapat bahwa merek GoTo yang didaftarkan tidak sejenis dengan merek yang GOTO yang telah terdaftar lebih dahulu dan Perlindungan hukum untuk merek GOTO dalam hal ini sudah memenuhi ketentuan Pasal 21 ayat (1) Undangundang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis tetapi terminologi perlindungan reputasi dalam penjelasan Pasal 21 huruf b belum mengakomodir seluruh lapisan perusahaan. Hanya melindungi perusahaan yang sudah terkenal secara hukum dan terdapat syarat yang sulit bagi perusahaan yang masih mengembangkan mereknya hanya untuk mendapatkan perlindungan reputasi. | |||||||||
