Abstract
Housing Infrastructure, Facilities and Utilities that have been completed by the organizer must be handed over to the Regional Government. To ensure the availability of infrastructure, facilities and utilities in Tangerang City, the Regional Government issued Tangerang City Regional Regulation Number 4 of 2023 concerning the Delivery of Housing Infrastructure, Facilities and Utilities. In accordance with the site plan Number: 653/69-SP/BPPT/2011 dated 2 February 2011 at Duta Bintaro Housing, the PSU that must be handed over according to the site plan is in proportion of 40% of the land area being developed, namely 132,024.00 m2 and the burial plot of 6,663.28m2 is not yet fully completed. delivery is made. Identify the problem in this research, what is the authority of the Tangerang City Regional Government in implementing the delivery of infrastructure, facilities and utilities at Duta Bintaro Housing based on Government Regulation Number 4 of 2023 concerning Amendments to Regional Regulation Number 5 of 2017 concerning the Delivery of Infrastructure, Facilities and Utilities Housing area? What are the obstacles faced by the Housing and Settlements Service in implementing the delivery of housing infrastructure, facilities and utilities at Duta Bintaro Housing complex based on Government Regulation Number 4 of 2023 concerning Amendments to Regional Regulation Number 5 of 2017 concerning the Delivery of Housing Infrastructure, Facilities and Utilities? The theories used are the theory of authority and the theory of legal certainty. The research method is empirical juridical. The research specifications used are analytical descriptive research. The research results are in the process of handing over infrastructure, facilities and utilities for Duta Bintaro housing through attribution authority because it is granted through Regional Regulations. The conclusion from the research results is that only 35% of the infrastructure, facilities and utilities at Duta Bintaro Housing were handed over with an area of 115,977.00m2 of the 40% land area that should have been due to several obstacles, namely differences in area and proof of land ownership. The suggestion in this research is that the Tangerang City Government needs to supervise and improve the role and function of the Department involved in the PSU handover process, as well as take firm action against developers or housing developers who violate the provisions and who have not handed over the PSU, so that no more parties suffer losses.

Untuk menjamin ketersediaan Prasarana, Sarana dan Utilitas di Kota Tangerang, Pemerintah Daerah menerbitkan Peraturan Daerah Kota Tangerang Nomor 4 Tahun 2023 tentang Penyerahan Prasarana, Sarana Dan Utilitas Perumahan. Sesuai dengan siteplan Nomor: 653/69-SP/BPPT/2011 tanggal 2 Februari 2011 di Perumahan Duta Bintaro, PSU yang harus diserahkan sesuai siteplan dengan proporsi 40% dari luas tanah yang dikembangkan yaitu seluas 132,024.00 m2 dan tanah pemakamakan seluas 6,663.28m2 belum sepenuhnya dilakukan penyerahan. Identifikasi masalah dalam penelitian ini, Bagaimana Kewenangan Pemerintah Daerah Kota Tangerang dalam Pelaksanaan Penyelenggaraan Penyerahan Prasarana, Sarana, Dan Utilitas di Perumahan Duta Bintaro berdasarkan Peraturan Pemerintah Nomor 4 Tahnun 2023 tentang Perubahan Atas Peraturan Daerah Nomor 5 Tahun 2017 tentang Penyerahan Prasarana, Sarana, Dan Utilitas Perumahan? Apa saja kendala yang dihadapi Dinas Perumahan dan Permukiman dalam Pelaksanaan Penyelenggaraan Penyerahan Prasarana, Sarana, dan Utilitas Perumahan di Perumahan Duta Bintaro berdasarkan Peraturan Pemerintah Nomor 4 Tahnun 2023 tentang Perubahan Atas Peraturan Daerah Nomor 5 Tahun 2017 Tentang Penyerahan Prasarana, Sarana, Dan Utilitas Perumahan? Teori yang digunakan yaitu, teori kewenangan dan teori kepastian hukum. Metode penelitian yaitu yuridis empiris. Spesikasi penelitian yang digunakan yaitu penelitian deskriptif analitis. Hasil penelitian adalah dalam proses penyerahan prasarana, sarana, dan utilitas perumahan Duta Bintaro melalui kewenangan atribusi karena diberikan melalui Peraturan Daerah. Kesimpulan dari hasil penelitian adalah dalam penyerahan prasarana, sarana, dan utilitas di Perumahan Duta Bintaro yang diserahkan hanya sebanyak 35% dengan luas 115.977.00m2 dari 40% luas tanah yang seharusnya dikarenakan beberapa kendala yaitu dalam perbedaan luasan dan bukti kepemilikan tanah. Saran dalam penelitian ini adalah Pemerintah Kota Tangerang perlu melakukan pengawasan dan meningkatkan peran dan fungsi Dinas yang terkait dalam proses penyerahan PSU, serta menindak secara tegas kepada pihak pengembang atau developer perumahan yang melanggar ketentuan dan yang belum menyerahkan PSU, sehingga tidak ada lagi pihak yang dirugikan. | |||||||||
