Abstract
Fintech (Financial Technology) or Peer to Peer Lending is a service that operates in the financial services sector. The application of fintech requires consumers to provide their personal information so that the use of fintech technology in the financial services sector is certainly not free from cyber crime. Many online loan consumers have experienced various cases of personal data leakage, one of which is consumers using the Akulaku online loan application. The identification of the problem in this research is how to protect consumers from leaks of personal data of online loan users on the Akulaku application based on Financial Services Authority Regulation Number 6/POJK.07/2022 concerning Consumer and Community Protection in the Financial Services Sector and what the responsibilities of business actors (Akulaku) are. against leaks of personal data of online loan users based on Financial Services Authority Regulation Number 6/POJK.07/2022 concerning Consumer and Public Protection in the Financial Services Sector. The theories used in this research are legal protection theory and responsibility theory. The research method used is a normative juridical method using secondary data in the form of library research and supported by primary data obtained by interviews. The research results show that legal protection for personal data of consumers/online loan users on the Akulaku Application has not been carried out in full in accordance with the provisions of Article 2 of the Financial Services Authority Regulation Number 6/POJK.07/2022 concerning Consumer and Public Protection in the Financial Services Sector. The responsibility given by Akulaku as a financial services business actor for losses to consumers/users of the Akulaku application has not been carried out optimally in accordance with Article 8 paragraph (1) of Financial Services Authority Regulation Number 6/POJK.07/2022 concerning Consumer and Public Protection in the Financial Services Sector . Suggestions: Akulaku is expected to be responsible regarding the consumer's personal data security system. And the public as consumers/users of online loans must be careful when entering their personal data or sensitive data into sites on the internet or online applications.

Pengaplikasian fintech mengharuskan konsumen untuk memberikan informasi pribadinya sehingga pemanfaatan teknologi fintech dalam sektor jasa keuangan tentunya tidak lepas dari cyber crime. Berbagai kasus kebocoran data pribadi banyak dialami oleh konsumen pinjaman online, salah satunya adalah konsumen pengguna aplikasi pinjaman online Akulaku. Identifikasi masalah dalam penelitian ini adalah bagaimana perlindungan konsumen atas kebocoran data pribadi pengguna pinjaman online pada aplikasi Akulaku berdasarkan Peraturan Otoritas Jasa Keuangan Nomor 6/POJK.07/2022 Tentang Perlindungan Konsumen Dan Masyarakat Di Sektor Jasa Keuangan dan bagaimana tanggung jawab pelaku usaha (Akulaku) terhadap kebocoran data pribadi pengguna pinjaman online berdasarkan Peraturan Otoritas Jasa Keuangan Nomor 6/POJK.07/2022 Tentang Perlindungan Konsumen Dan Masyarakat Di Sektor Jasa Keuangan. Teori yang digunakan dalam penelitian ini adalah teori perlindungan hukum dan teori tanggung jawab. Metode penelitian yang digunakan adalah metode yuridis normatif dengan menggunakan data sekunder berupa penelitian kepustakaan dan didukung dengan data primer yang diperoleh dengan wawancara. Hasil penelitian menunjukan bahwa perlindungan hukum terhadap data pribadi konsumen/pengguna pinjaman online pada Aplikasi Akulaku belum dilakukan secara penuh sesuai dengan ketentuan Pasal 2 Peraturan Otoritas Jasa Keuangan Nomor 6/POJK.07/2022 Tentang Perlindungan Konsumen Dan Masyarakat Di Sektor Jasa Keuangan. Tanggung jawab yang diberikan oleh Akulaku sebagai pelaku usaha jasa keuangan terhadap kerugian konsumen/pengguna aplikasi Akulaku belum dilakukan secara maksimal sesuai Pasal 8 ayat (1) Peraturan Otoritas Jasa Keuangan Nomor 6/POJK.07/2022 Tentang Perlindungan Konsumen Dan Masyarakat Di Sektor Jasa Keuangan. Saran Kepada pihak Akulaku, diharapkan dapat bertanggung jawab mengenai sistem keamanan data pribadi konsumen. Serta bagi masyarakat selaku konsumen/pengguna pinjaman online harus berhati-hati dalam memasukkan data pribadi atau data sensitifnya ke dalam situs di internet atau aplikasi online. | |||||||||
