Abstract
Golok Banten Ciomas is a historical object which was a symbol of royal era civilization as a symbol of honor and champion status. Golok Banten Ciomas is not only famous in Indonesia but abroad. So there is a need for preservation so that the machete culture is not lost and its authenticity is maintained. To be protected, the state must make an inventory. Golok Banten Ciomas is not only intended as traditional culture, as tourism in Banten develops, they use it to commercialize it both directly and online in e-commerce. Identification of the problem is how to develop the protection of the Golok Banten Ciomas Traditional Cultural Expression work after inventorying activities in the National Data Center for Communal Intellectual Property and what efforts can be made by the owner of the Golok Banten Ciomas Traditional Cultural Expression towards commercial use by the community. The theories used are the theory of legal certainty and the theory of legal responsibility. The research method used is normative empirical, with legal enforcement research specifications. The data used is secondary and primary, with data collection techniques from library studies and field studies and the data analysis used is descriptive qualitative. The results of this research state that, the development of legal protection for the Traditional Cultural Expression of the Golok Banten Ciomas after inventory activities in its implementation cannot be carried out because it is not maintained in accordance with Article 28 and maintenance is not carried out in accordance with Article 29, resulting in the protection of the Golok Banten Ciomas being protected in EBT through the KIK scope is cut off. Efforts that can be made by the owner of the Golok Banten Ciomas Traditional Cultural Expression towards commercial use by the community cannot be carried out. This is because data regarding use by other parties which are considered to violate the rights of the Ciomas community as owners of EBT from Golok Ciomas is not known to have been recorded in the community. Until now, the community has only made efforts at the security, maintenance and publication stages. However, this is not effective in protecting Golok Banten Ciomas from commercial use by the community. Suggestions that can be given are that relevant stakeholders need to review regulations and create the best mechanisms that do not make things difficult for the community and need to increase public awareness to understand EBT so that it can provide benefits and benefits from an economic perspective for people who own communal wealth.

| Additional Information: | Golok merupakan benda sejarah yang merupakan simbol peradaban zaman kerajaan sebagai lambang kehormatan dan derajat jawara. Golok Banten Ciomas tidak hanya terkenal di Indonesia tetapi di mancanegara. Maka perlu adanya pelestarian, untuk dapat dilindungi negara wajib menginventarisasi. Saat ini Golok Banten Ciomas tidak hanya diperuntukkan sebagai budaya adat saja seiring berkembangnya pariwisata di Banten mereka memanfaatkannya untuk dikomersialisasikan baik secara langsung maupun daring pada e-commerce. Identifikasi masalah yaitu bagaimana pengembangan perlindungan karya Ekspresi Budaya Tradisional Golok Banten Ciomas setelah kegiatan penginventarisan dalam Pusat Data Nasional Kekayaan Intelektual Komunal dan bagaimana upaya-upaya yang dapat dilakukan oleh pemilik Ekspresi Budaya Tradisional Golok Banten Ciomas terhadap pemanfaatan secara komersial oleh masyarakat. Teori yang digunakan teori kepastian hukum dan teori tanggung jawab hukum. Metode penelitian yang digunakan yaitu normatif empiris, dengan spesifikasi penelitian keberlakuan hukum. Data yang digunakan yaitu sekunder dan primer, dengan teknik pengumpulan data studi kepustakaan dan studi lapangan serta analisis data yang digunakan yaitu deskriptif kualitatif. Hasil penelitian ini menyatakan bahwa, Pengembangan perlindungan hukum Ekspresi Budaya Tradisional Golok Banten Ciomas setelah kegiatan penginventarisan dalam pengimplementasiannya tidak dapat dilaksanakan pengembangannya oleh karena tidak dilakukan penjagaan sesuai dengan Pasal 28 dan tidak dilakukan pemeliharaan sesuai dengan Pasal 29, menyebabkan perlindungan Golok Banten Ciomas yang dilindungi dalam EBT melalui lingkup KIK terputus. Upaya-upaya yang dapat dilakukan oleh pemilik Ekspresi Budaya Tradisional Golok Banten Ciomas terhadap pemanfaatan secara komersial oleh masyarakat tidak dapat dilakukan. Dikarenakan data mengenai pemanfaatan oleh pihak lain yang dianggap melanggar hak dari masyarakat Ciomas selaku pemilik EBT dari Golok Ciomas tidak diketahui adanya pelaporan yang terdata dalam masyarakat. Sampai saat ini masyarakat hanya melakukan upaya pada tahap pengamanan, pemeliharaan dan pempublikasian. Akan tetapi hal tersebut tidak efektif dalam melindungi Golok Banten Ciomas terhadap pemanfaatan secara komersial oleh masyarakat. Saran yang dapat diberikan yaitu stakeholder terkait perlu meninjau kembali regulasi serta membuat mekanisme terbaik yang tidak menyulitkan masyarakat dan perlu meningkatkan kesadaran masyarakat untuk memahami EBT agar dapat memberi manfaat dan keuntungan dari segi ekonomi bagi masyarakat yang memiliki kekayaan komunal tersebut. | |||||||||
