Abstract
Rape refers to the word "rape" which means force, gallantry, strength, might. To rape means to subdue by force, to ravish, to violate (attack, etc.) by force. One alternative to solving criminal cases is by implementing the concept of restorative justice, Restorative Justice is an alternative or other way of criminal justice by prioritizing an integrated approach of perpetrators on the one hand and victims / communities on the other hand as a unit to find solutions and return to the pattern of good relations in society. The identification of problems in this study is how to implement the Restorative Justice mechanism against rape crimes? and how law enforcement against perpetrators of rape crimes on female employees in the Ministry of Cooperatives and SMEs that use Restorative Justice settlement mechanisms?. The theories used in this study are Restorative Justice Theory and Law Enforcement Theory. This research was conducted using normative juridical methods using laws and regulations and legal principles in the research approach. The data sources used in this study are secondary data sources that are analyzed qualitatively. The result obtained from this study is that rape cannot be solved using the mechanism of Restorative Justice, because crimes that can be solved using Restorative Justice are Minor Crimes (Tipiring), crimes that have a loss value of not more than Rp2,500,000.00 (two million five hundred thousand rupiah), Child Crimes, and crimes that have a penalty of imprisonment of not more than 5 (five) years. Meanwhile, the crime of rape based on Article 286 of the Criminal Code has a maximum prison sentence of 9 years. This study concluded that criminal law enforcement against perpetrators of rape crimes against KemenKop UKM employees using the Restorative Justice mechanism by marrying perpetrators with victims is inappropriate. Because this shows that there is unprofessionalism in law enforcement officials in handling this case. So that the suggestions in this study are expected to the Indonesian National Police to be able to use Restorative Justice in accordance with the legal basis for the application of the mechanism.

Memperkosa berarti menundukkan dengan kekerasan, menggagahi, melanggar (menyerang, dsb) dengan kekerasan. Salah satu alternatif penyelesaian perkara pidana yakni dengan melaksanakan konsep keadilan restoratif (restorative justice), Restorative Justice merupakan alternatif atau cara lain peradilan kriminal dengan mengedepankan pendekatan integrasi pelaku di satu sisi dan korban/ masyarakat di lain sisi sebagai satu kesatuan untuk mencari solusi serta kembali pada pola hubungan baik dalam masyarakat. Identifikasi masalah dalam penelitian ini adalah bagaimana pelaksanaan mekanisme Restorative Justice terhadap tindak pidana perkosaan? dan bagaimana penegakan hukum terhadap pelaku tindak pidana perkosaan pada pegawai perempuan di KemenKop dan UKM yang menggunakan mekanisme penyelesaian Restorative Justice?. Teori yang digunakan dalam penelitian ini adalah Teori Restorative Justice dan Teori Penegakan Hukum. Penelitian ini dilakukan dengan metode yuridis normatif dengan menggunakan peraturan perundang-undangan serta asas-asas hukum dalam pendekatan penelitian. Sumber data yang digunakan dalam penelitian ini adalah sumber data sekunder yang dianalisis secara kualitatif. Hasil yang diperoleh dari penelitian ini adalah perkosaan tidak bisa diselesaikan menggunakan mekanisme Restorative Justice, karena tindak pidana yang dapat diselesaikan menggunakan Restorative Justice adalah Tindak Pidana Ringan (Tipiring), tindak pidana yang memiliki nilai kerugian tidak lebih dari Rp2.500.000,00 (dua juta lima ratus ribu rupiah), Tindak Pidana Anak, serta tindak pidana yang memiliki ancaman pidana penjara tidak lebih dari 5 (lima) tahun. Sedangkan, tindak pidana perkosaan berdasarkan Pasal 286 KUHP memiliki ancaman penjara paling lama 9 tahun. Penelitian ini menghasilkan kesimpulan bahwa penegakan hukum pidana terhadap pelaku tindak pidana perkosaan pada pegawai KemenKop UKM menggunakan mekanisme Restorative Justice dengan cara mengawinkan pelaku dengan korban tidaklah tepat. Karena hal ini menunjukkan bahwa adanya ketidakprofesionalan pada aparat penegak hukum dalam menangani kasus ini. Sehingga saran dalam penelitian ini diharapkan kepada Kepolisian Republik Indonesia dapat menggunakan Restorative Justice sesuai dengan dasar hukum penerapan mekanisme tersebut. | |||||||||
