Abstract
The problem of housing consumers has never been resolved, even though the government has promulgated the UUPK since 1999. In relation to housing consumers, there is also the problem of default by developers regarding social facilities and public facilities at the Griya Alam Sentosa Housing Complex. In reality, at the Griya Alam Sentosa Housing Complex, land for social facilities and public facilities is misused. Identification of the problem, namely, what is the legal protection for housing consumers for defaults made by developers regarding the provision of social facilities and public facilities at Griya Alam Sentosa Housing Bogor and what is the form of consumer dispute resolution for defaults made by developers regarding the provision of social facilities and public facilities at Griya Housing Alam Sentosa Bogor. The theory used is the theory of legal protection and legal certainty. The research method used is an empirical normative research method with case study research specifications. The data used are primary data and secondary data, with library study data collection techniques which are also supported by primary data through field studies. The data analysis used is descriptive qualitative. The results of this research state that Griya Alam Sentosa Housing Consumers are still lacking in protection because legal protection for housing consumers for defaults by developers is not implemented as regulated in the UUPK and UUPKP. The Griya Alam Sentosa Housing Developer, as of this research, has not been responsible for its actions. The suggestion is that developers as business actors must be responsible for their acts of default, namely by fulfilling consumers' rights to the promised social and public facilities or providing compensation. The government needs to increase supervision of business actors, especially housing developers, who do not guarantee the availability of social facilities and public housing facilities. As well as providing outreach to business actors and consumers regarding their rights and obligations in order to create legal protection and certainty and minimize the occurrence of disputes.

Additional Information: | Permasalahan konsumen perumahan tidak pernah selesai, meskipun demikian pemerintah sudah mengundangkan UUPK sejak tahun 1999. Sehubungan dengan konsumen perumahan, juga terdapat masalah wanprestasi yang dilakukan pengembang terhadap fasilitas sosial dan fasilitas umum di Perumahan Griya Alam Sentosa. Pada kenyataannya di Perumahan Griya Alam Sentosa lahan untuk fasilitas sosial dan fasilitas umum disalahgunakan. Identifikasi masalah yaitu, Bagaimana perlindungan hukum terhadap konsumen perumahan atas wanprestasi yang dilakukan pengembang terhadap penyediaan fasilitas sosial dan fasilitas umum di Perumahan Griya Alam Sentosa Bogor? dan Bagaimana bentuk penyelesaian sengketa konsumen atas wanprestasi yang dilakukan oleh pengembang terhadap penyediaan fasilitas sosial dan fasilitas umum di Perumahan Griya Alam Sentosa Bogor? Teori yang digunakan yaitu teori perlindungan hukum dan kepastian hukum. Metode penelitian yang digunakan yaitu metode penelitian normatif empiris dengan spesifikasi penelitian studi kasus. Data yang digunakan yaitu data primer dan data sekunder, dengan teknik pengumpulan data studi pustaka yang didukung pula dengan data primer melalui studi lapangan. Analisis data yang digunakan yaitu deskriptif kualitatif. Hasil penelitian ini menyatakan bahwa Konsumen Perumahan Griya Alam Sentosa masih kurang dilindungi karena perlindungan hukum konsumen perumahan atas wanprestasi yang dilakukan pengembang tidak terlaksana sebagaimana diatur dalam UUPK dan UUPKP. Pengembang Perumahan Griya Alam Sentosa sampai pada penelitian ini belum bertanggung jawab atas perbuatannya. Adapun yang menjadi saran yaitu pihak pengembang sebagai pelaku usaha harus bertanggungjawab atas perbuatan wanprestasi yang dilakukannya, yaitu dengan memenuhi hak konsumen atas fasilitas sosial dan fasilitas umum yang dijanjikan atau memberikan kompensasi. Pemerintah, khususnya pemerintah daerah perlu meningkatkan pengawasan terhadap pelaku usaha khususnya pengembang perumahan yang tidak menjamin ketersediaan fasilitas sosial dan fasilitas umum perumahan. Serta melakukan sosialisasi bagi para pelaku usaha maupun konsumen terkait hak dan kewajibannya agar terwujudnya perlindungan dan kepastian hukum serta meminimalisir terjadinya sengketa. | |||||||||
