Abstract

ABSTRACT The role of the General Election Commission in protecting personal data is one of the important aspects that needs to be implemented in the implementation of elections, where during the election stages personal data from the public is used. Therefore, there needs to be efforts to protect personal data. The Serang City General Election Commission in implementing personal data protection cannot be said to be perfect in its implementation. Regarding this problem, how is the role of the Serang City General Election Commission implemented in protecting personal data on Population Identification Numbers in the General Election process based on General Election Commission Regulation Number 6 of 2021 concerning Continuous Updating of Voter Data. What are the obstacles to implementing the role of the Serang City General Election Commission in efforts to protect personal data in the general election process based on General Election Commission Regulation Number 6 of 2021 concerning Continuous Updating of Voter Data. The theories used in this research are the theory of authority and the theory of legal protection. The method used in this research is empirical juridical with data analysis through a qualitative approach using primary data in the form of interviews with the head of the planning division, data and information from the Serang City General Election Commission & Election Supervisory Agency Serang City and secondary data in the form of literature related to research. The research results obtained are, Implementing the role of the Serang City General Election Commission in implementing personal data protection, the KPU plays a role, with 6 procedures, namely identification and inventory, determining the personin charge, interests of work units, data classification, changing passwords periodically, not sharing/ reveal the password in Article 49 of General Election Commission Regulation Number 6 of 2021 concerning Continuous Updating of Voter Data which is the authority delegated to the Serang City General Election Commission based on Article 7 PKPU Number 6 of 2021 concerning Continuous Voter Data Updating. Obstacles in protecting personal data in the election process include the system being still located at the central level so that there is overlapping data which results in one name with two addresses. Conclusion The role of the General Election Commission in implementing personal data protection in accordance with the source of attribution authority is not fully implemented, because there are still many allegations of violations that occurred in the general election process. Suggestion, there needs to be a revision regarding the General Election Commission Regulations regarding sanctions, no sanctions and regulations used to ensnare individuals who disseminate personal data. Komisi Pemilihan Umum Kota Serang dalam pelaksanaan perlindungan data pribadi belum dapat dikatakan dengan sempurna dalam pelaksanaannya. Adapun identifikasi masalahnya, Bagaimana Pelaksanaan Peran Komisi Pemilihan Umum Kota Serang dalam Perlindungan Data Pribadi Nomor Induk Kependudukan dalam proses Pemilihan Umum berdasarkan Peraturan Komisi Pemilihan Umum Nomor 6 Tahun 2021 tentang Pemutakhiran Data Pemilih Berkelanjutan. Apa yang menjadi kendala Pelaksanaan Peran Komisi Pemilihan Umum Kota Serang dalam upaya Perlindungan Data Pribadi dalam Proses Pemilihan Umum Berdasarkan Peraturan Komisi Pemilihan Umum Nomor 6 Tahun 2021 tentang Pemutakhiran Data Pemilih Berkelanjutan. Teori yang digunakan dalam penelitian ini yaitu, teori kewenangan dan teori perlindungan hukum, Metode yang digunakan dalam penelitian ini yuridis empiris dengan analitis data melalui pendekatan kualitatif menggunakan data primer berupa wawancara kepala divisi perencanaan, data dan informasi Komisi Pemilihan Umum Kota Serang & Badan Pengawasan Pemilu Kota Serang dan data sekunder berupa pustaka yang berkaitan dengan penelitian. Hasil penelitian yang didapat yaitu, Implementasi peran Komisi Pemilihan Umum Kota Serang dalam penerapan perlindungan data pribadi, KPU melakukan peran, dengan 6 prosedur yaitu identifikasi dan inventarisasi, penetapan penanggung jawab, kepentingan satker, klasifikasi data, mengganti kata sandi secara berkala, tidak membagi/memberitahukan kata sandi dalam Pasal 49 Peraturan Komisi Pemilihan Umum Nomor 6 Tahun 2021 tentang Pemutakhiran Data Pemilih Berkelanjutan yang merupakan kewenangan yang di delegasikan kepada Komisi Pemilihan Umum Kota Serang berdasarkan Pasal 7 PKPU Nomor 6 tahun 2021 tentang Pemutakhiran Data Pemilih Berkelanjutan. Kendala dalam perlindungan data pribadi dalam proses pemilu di antaranya yaitu, terkait dengan sistem yang masih terletak ditingkat pusat sehingga terdapat tumpang tindih data yang mengakibatkan terjadinya satu nama dengan dua alamat. Kesimpulan Peran Komisi Pemilihan Umum dalam penerapan perlindungan data pribadi sesuai dengan sumber kewenangan atribusi yang tidak seluruhnya terlaksana, karena masih banyak dugaan pelanggaran yang terjadi pada proses pemilihan umum. Saran, Perlu adanya revisi terkait Peraturan Komisi Pemilihan Umum mengenai sanksi karena tidak ada kejelasan sanksi serta regulasi yang digunakan dalam menjerat oknum penyebarluasan data pribadi tersebut.
