Abstract
PT. Kereta Commuter Indonesia (KCI) is an electric rail transportation provider. As mass transportation that covers a wide area, PT. KCI must provide good service by guaranteeing consumer rights, namely the right to security, comfort and safety, but in the implementation of PT. KCI has not provided maximum service to consumers, both in terms of facilities and infrastructure. The problems above made the writer interested in conducting research by taking two problem identifications. First, what are the responsibilities of PT. KCI in protecting the rights of electric train service users, especially regarding passenger luggage? Second, what legal efforts does KRL management take to deal with the problem of lost goods? This research uses the theory of legal protection and legal certainty. The method used in this research is normative juridical with a statutory approach and a conceptual approach. The data used is secondary data and primary data as support. The findings from this research show that PT. Indonesian Commuter Trains are responsible for protecting passengers' luggage. The results of this research are PT. KCI as a service user has not carried out its responsibilities in providing protection and certainty of consumer rights in accordance with Article 4 letter (a) of Law Number 8 of 1999 concerning consumer protection, namely the rights to, security, comfort, in Article 133 paragraph (1) Law Number 23 of 2007 concerning Railways states that PT. KCI is obliged to prioritize safety and security, comply with train schedules, prioritize service, but in this case PT. KCI has not carried out its responsibilities well. PT. In this case, KCI should make efforts such as evaluating the service performance or SOPs used, adding missing facilities such as the number of carriages and CCTV, reducing passenger capacity in one carriage and providing training to train security officers so that they are better able to discipline passengers when getting on and off the train. as well as providing education to consumers about criminal acts to avoid harm to consumers. Additional Information: | PT. Kereta Commuter Indonesia (KCI) merupakan penyelenggara transportasi kereta api rel listrik. Sebagai transportasi massal yang mencakup wilayah luas PT.KCI harus memberikan pelayanan yang baik dengan menjamin hak konsumen yaitu hak atas keamanan, kenyamanan dan keselamatan, namun pada pelaksanan PT. KCI belum memberikan pelayanan yang maksimal kepada konsumen baik dari sarana maupun prasarana. Permasalahan diatas membuat penulis tertarik untuk melakukuan penelitian dengan mengambil dua identifikasi masalah. Pertama, bagaimana tanggungjawab PT. KCI dalam melindungi hak-hak pengguna jasa kereta rel listrik khususnya terhadap barang bawaan penumpang? Kedua, upaya hukum apa yang dilakukan pihak menagement KRL dalam menghadapi permasalahan barang hilang? Penelitian ini menggunakan teori perlindungan hukum dan kepastian hukum. Metode yang digunakan penelitian ini adalah yuridis normatif. Data yang digunakan adalah data sekunder dan data primer sebagai penunjangnya. Temuan dari hasil penelitian ini menunjukkan bahwa PT. Kereta Commuter Indonesia bertanggung Jawab dalam melindungi barang bawaan penumpang. Hasil dari penelitian ini yaitu PT. KCI sebagai pengguna jasa belum melaksanakan tanggungwajabnya dalam memberikan perlindungan dan kepastian hak-hak konsumen yang sesuai dengan Pasal 4 huruf (a) Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan konsumen yaitu hak atas, keamanan, kenyamanan, dalam Pasal 133 ayat (1) Undang-Undang Nomor 23 Tahun 2007 Tentang Perkeretaapian bahwa PT. KCI wajib mengutamakan keselamatan dan keamanan, mematuhi jadwal kereta api, mengutamakan pelayanan, namun dalam hal ini PT. KCI belum melaksanakan tanggung jawabnya dengan baik. PT. KCI dalam hal ini sebaiknya melakukan upaya-upaya seperti melakukan evalusi kinerja pelayanan atau SOP yang digunakan, menambahkan fasilitas yang kurang seperti jumlah gerbong dan cctv, mengurangi kapasitas penumpang dalam satu gerbong dan memberikan penyuluhan petugas keamanan kereta agar lebih mampu mendisiplinkan penumpang ketika naik turun kereta serta memberikan edukasi kepada konsumen tentang tindakan kriminal untuk menghindari kerugian bagi konsumen.
