Abstract

The village head election in Lebak Regency which is held every 6 (six) years in practice often creates disputes or disputes. The village head election dispute even had to end up in court because of a government administration decision that violated/against the law (onrechmatige overheidsdaad). Based on the background, the problem was identified: How is the Village Head Election Dispute Settlement in Lebak Regency? What is the authority to adjudicate unlawful acts by government bodies and/or officials in village head election disputes in Lebak district? Theories used to analyze the research are rule of law theory, authority theory, and good governance theory. The type of research used is normative and empirical legal research. Based on the results of the research that has been carried out, it can be concluded that: Settlement of village head election disputes in Lebak Regency is the method used to resolve disputes through peace and/or court, which occurs in: a. Administrative Disputes; and b. Dispute over Village Head Election Results. Peaceful settlement of administrative disputes is carried out through complaints and reports to the Village Head Selection Committee accompanied by reasons and evidence. Meanwhile, the settlement of election result disputes must be resolved by the Regent within a period of 30 (thirty) days from the date of receipt of submission of election results by the Village Head Selection Committee. If the amicable resolution is not successful, then the disputing parties carry out a settlement through the State Administrative Court. The authority to try unlawful acts by government bodies and/or officials in disputes over the election of the Village Head in Lebak Regency is the authority of the State Administrative Court as a result of the issuance of a government administrative decision which is the object of the dispute. Researchers found two forms of objects of dispute in the simultaneous election of village heads in Lebak Regency, namely: a. Dispute on Minutes of Determination of Village Head Candidates; and b. Dispute on the Decree of the Lebak Regent regarding Approval and Appointment of Elected Village Heads.

Additional Information:	Pemilihan Kepala Desa di Kabupaten Lebak yang dilaksanakan setiap 6 (enam) tahun sekali dalam praktiknya seringkali menimbulkan perselisihan atau sengketa. Perselisihan Pilkades tersebut bahkan harus berujung ke pengadilan karena adanya keputusan administrasi pemerintahan yang melanggar/melawan hukum (onrechmatige overheidsdaad). Berdasarkan latar belakang, maka teridentifikasi masalah: Bagaimana Penyelesaian Sengketa Pemilihan Kepala Desa di Kabupaten Lebak? Bagaimana Kewenangan Mengadili Perbuatan Melawan Hukum oleh Badan dan/atau Pejabat Pemerintah Dalam Sengketa Pemilihan Kepala Desa di Kabupaten Lebak? Teori yang digunakan untuk menganalisis penelitian adalah teori negara hukum, teori kewenangan, dan teori good governance. Jenis penelitian yang digunakan merupakan penelitian hukum normatif dan empiris. Berdasarkan hasil penelitan yang telah dilakukan, maka dapat dibuat kesimpulan bahwa: Penyelesaian sengketa pemilihan Kepala Desa di Kabupaten Lebak adalah cara yang digunakan untuk menyelesaikan sengketa melalui Damai dan/atau Pengadilan, yang terjadi pada: a. Sengketa Administratif; dan b. Sengketa Hasil Pemilihan Kepala Desa. Penyelesaian Damai dalam sengketa administratif dilakukan melalui pengaduan dan laporan kepada Panitia Pemilihan Kepala Desa disertakan dengan alasan-alasan dan bukti-bukti. Sementara penyelesaian sengketa hasil pemilihan harus diselesaikan oleh Bupati dalam jangka waktu 30 (tiga puluh) hari sejak tanggal diterimanya penyampaian hasil pemilihan oleh Panitia Pemihan Kepala Desa. Apabila penyelesaian Damai tidak berhasil, maka pihak bersengketa melakukan penyelesaian melalui Pengadilan Tata Usaha Negara. Kewenangan mengadili perbuatan melawan hukum oleh badan dan/atau pejabat pemerintah dalam sengketa pemilihan Kepala Desa di Kabupaten Lebak merupakan kewenangan pengadilan Tata Usaha Negara akibat dikeluarkannya keputusan administrasi pemerintah yang menjadi objek sengketa. Peneliti menemukan dua bentuk objek sengketa dalam pemilihan kepala Desa serentak Kabupaten Lebak yaitu : a. Sengketa Berita Acara Penetapan Calon Kepala Desa; dan b. Sengketa Surat Keputusan Bupati Lebak tentang Pengesahan dan Pengangkatan Kepala Desa Terpilih.
