Abstract
ABSTRAK PERLINDUNGAN HUKUM TENAGA MEDIS TERHADAP KESELAMATAN DAN KESEHATAN KERJA DALAM MELAYANI PASIEN COVID-19 RSU BANTEN BERDASARKAN UNDANG-UNDANG NOMOR 36 TAHUN 2014 TENTANG TENAGA KESEHATAN Fenomena pembatasan distribusi pemberian masker dan tunggakan insentif memperparah kondisi kesehatan dan keselamatan kerja tenaga medis. Akibat dari kebijakan management rumah sakit membuat tenaga medis kehilangan hak-hak nya yang seharusnya mendapat perlindungan secara hukum. Tujuan penelitian ini (1) Untuk menjelaskan dan menganalisa alasan tenaga kesehatan di RSU Banten sebagai rumah sakit rujukan Covid-19 belum maksimal dalam hal perlindungan keselamatan dan kesehatan kerja berdasarkan undang-undang nomor 36 tahun 2014 tentang tenaga Kesehatan. (2) Untuk menjelaskan dan menganalisa penerapan tanggung jawab pemerintah dalam perlindungan keselamatan dan kesehatan kerja tenaga kesehatan di RSU Banten berdasarkan undang-undang nomor 36 tahun 2014 tentang tenaga Kesehatan. Metode yang digunakan dalam penelitian ini adalah metode deskriptif yuridis normative dengan menggunakan pendekatan permasalahan dengan Undang-Undang dengan mengedepankan data primer dan data sekunder. Analisa data penelitian ini menggunakan analisis kualitatif. Hasil dari penelitian ini menunjukkan bahwa alasan manajemen RSU Banten belum maksimal memberikan perlindungan keselamatan dan Kesehatan kerja berkaitan dengan bantuan APD dari pusat yang terbatas. Penerapan tanggung jawab pemerintah dalam hal ini dianggap belum maksimal dalam mendistribusikan APD serta pencairan dana tunjangan bagi tenaga medis yang bertugas di ruang isolasi selama masa pandemi.

| Additional Information: | ABSTRACT Legal Protection for Medical Personnel Against Occupational Safety and Health in Serving COVID-19 Patients RSU Banten Based on Law Number 36 of 2014 Concerning Health Workers The phenomenon of restrictions on the distribution of masks and arrears of incentives has exacerbated the health and safety conditions for medical workers. As a result of hospital management policies, medical personnel lose their rights which should receive legal protection. The purpose of this research is (1) to explain and analyze the reasons why health workers at RSU Banten as a Covid-19 referral hospital are not optimal in terms of protecting occupational safety and health based on law number 36 of 2014 concerning health workers. (2) To explain and analyze the application of government responsibility in protecting the occupational safety and health of health workers in RSU Banten based on law number 36 of 2014 concerning health workers. The method used in this study is a normative juridical descriptive method using a problem approach with the law by prioritizing primary data and secondary data. Analysis of this research data using qualitative analysis. The results of this study indicate that the reason for the management of the Banten Public Hospital has not optimally provided occupational safety and health protection related to PPE assistance from the limited center. In this case, the implementation of government responsibility is considered not optimal in distributing PPE and disbursing allowance funds for medical personnel who work in isolation rooms during a pandemic. | |||||||||
