Abstract

Pengertian wakaf adalah pemberian suatu harta milik pribadi menjadi kepentingan bersama, sehingga kegunaanya mampu dirasakan masyarakat luas tanpa mengurangi nilai harta tersebut.Tata cara wakaf tanah hak milik berdasarkan Undang-Undang Nomor 41 Tahun 2004 j.o Peraturan Pemerintah Nomor 42 Tahun 2006 melalui proses;Ikrar wakaf,pendaftaran,pengumuman. Berdasarkan yang peneliti lakukan di Desa Ciputri Kecamatan Kaduhejo merupakan Desa dengan mayoritas 99% beragama Islam.namun, pemasalahan perwakafan muncul dalam tahap implementasi. Hal ini ditunjukan banyaknya harta benda wakaf yang belum dicatatkan di Kantor Urusan Agama untuk melakukan pendaftaran Akta ikrar wakaf dan tanah wakaf belum sertifikat wakaf.Identifikasi masalah yaitu, Bagaimana pelaksanaan praktek perwakafan di Desa Ciputri menurut Undang- Undang Nomor 41 Tahun 2004 juncto Peraturan Pemerintah Nomor 42 Tahun 2006?dan Bagaimana kepastian hukum atas tanah wakaf yang tidak didaftarkan di tinjau dari Undang-Undang Nomor 41Tahun 2004 juncto Peraturan Pemerintah Nomor 42 Tahun 2006? Teori yang digunakan kepastian hukum dan kesadaran hukum.Metode penelitiannormatif empiris dengan spesifikasi penelitian Perundang-Undang dan pendekatan kasus.Sumber data yang digunakan data sekunder dan data primer dengan menggunakan teknik pengumpulan data dan studi kepustakaan dan studi lapangan serta dianalisis secara deskriptif kualitatif.Hasil yang diperoleh dalam penelitian: pelaksanaan perwakafan sebagian besar hanya bersifat keagamaan atau kekeluargaan, serta melaksanakan wakaf hanya kepada pihak nazhir yang disaksikan oleh warga setempat dan perangkat Desa. Dari 28 wakaf di Desa Ciputri Kecamatan Kaduhejo ada 2 yang sudah memiliki Akta Ikrar Wakaf dan belum sertifikat wakaf disebabkan karena faktor; kurangnya pemahaman wakif terhadap akta ikrar, nazhir yang tidak profesional, kurangnya sosialisasi, kurangnya kepedulian masyarakat. Kesimpulan:menurut hukum positif tanah wakaf harus ditunjang dengan pencatatan adminstrasi agar tanah wakaf tersebut dapat memiliki perlindungan hukum agar wakaf tersebut terhindar dari penyalahgunaan serta penyimpangan oleh pihak yang tidak bertangung jawab. Saran: Pemerintah diharapkan memberikan sosialisasi mengenai pelaksanaan perwakafan dalam bentuk AIW maupun APAIW dalam melindungi tanah wakaf.

Additional Information:	The definition of waqf is to provide private property for the common good, so that its use can be felt by the wider community without reducing the value of the property. The procedure for waqf of privately owned land is based on Law Number 41 of 2004 j.o Government Regulation Number 42 of 2006 through the process; Waqf pledge , registration, announcement. Based on what researchers did in Ciputri Village, Kaduhejo District, it is a village with a 99% Muslim majority. however, waqf problems arise in the implementation stage. This is shown by the large number of waqf assets that have not been registered at the Office of Religious Affairs to register the waqf pledge deed and the waqf land has not yet received a waqf certificate. Identification of the problem, namely, What is the process of implementing waqf practices in Ciputri Village according to Law Number 41 of 2004 in conjunction with Government Regulation Number 42 of 2006? and How is legal certainty over waqf land that is not detrimental to the review of Law Number 41 of 2004 in conjunction with Government Regulation Number 42 of 2006? Theory that uses legal certainty and legal awareness.Empirical normative research method with the research specifications of the law and the case approach. Data sources used secondary data and primary data using data collection techniques and literature studies and field studies and analyzed descriptively qualitatively. The results obtained in the research: the implementation of endowments is mostly only religious or familial in nature, and implementing waqf only to nazhir parties witnessed by local residents and village officials. Of the 28 waqfs in Ciputri Village, Kaduhejo District, there were 2 who already had a Waqf Pledge Deed and did not have a waqf certificate due to factors; lack of understanding of the wakif regarding the pledge deed, unprofessional nazhir, lack of outreach, lack of public concern. Conclusion: according to positive law waqf land must be supported by administrative records so that the waqf land can have legal protection so that the waqf is protected from accidents and irregularities by irresponsible parties. Suggestion: The government is expected to provide socialization regarding the implementation of waqf in the form of AIW and APAIW in protecting waqf land.
