Additional Information:	Kasus Prostitusi online banyak merebak, akan tetapi kebanyakan hakim dalam memutus perkara dengan mengenakan Pasal dalam KUHP, seharusnya hakim dapat memutus kasus tersebut berdasarkan Undang-Undang Nomor 11 Tahun 2008 jo Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik karena pelaku melakukan tindak pidana tersebut melalui online berarti bukan hanya mucikarinya saja akan tetapi Pekerja Seks Komersial dan pemakai jasa prostitusi dapat dikenakan dengan unsur Pasal dalam Undang-Undang Nomor 11 Tahun 2008 jo Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik. Adanya indikasi masalah yaitu pertama Bagaimana Ratio Decidendi terhadap pelaku tindak pidana prostitusi secara online dalam Putusan Nomor : 31/Pid.Sus/2021/PN Jkt.Utr dan kedua Bagaimana pertanggungjawaban pidana terhadap pelaku prostitusi secara online menurut Undang-Undang Nomor 11 Tahun 2008 Jo Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik. Penelitian ini adalah penelitian yuridis normatif, maka pendekatan yang digunakan adalah pendekatan penelitian studi kasus. Data yang diperoleh di analisis secara data kualitatif. Hasil penelitian ini menunjukan bahwa Ratio Decidendi hakim terhadap pelaku tindak pidana prostitusi secara online dalam Putusan Nomor : 31/Pid.Sus/2021/PN Jkt.Utr tersebut diatas hakim mempertimbangkan dengan putusan Pasal KUHP yang seharusnya menurut peneliti hakim dapat memutus kasus tersebut berdasarkan Undang-Undang Nomor 11 Tahun 2008 jo Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik karena pelaku melakukan tindak pidana tersebut melalui online berarti bukan hanya mucikarinya saja akan tetapi pelaku laki-laki maupun perempuan dapat dikenakan dengan unsur pasal dalam Undang-Undang Nomor 11 Tahun 2008 jo Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik dan Pertanggungjawaban pidana terhadap pelaku prostitusi secara online menurut Undang-Undang Nomor 11 Tahun 2008 jo UndangUndang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik yaitu pelaku prostitusi online sudah diatur dalam beberapa peraturan perundangundangan yang ada di Indonesia, yaitu : Undang-undang Nomor 11 tahun 2008 jo Undang-undang Nomor 19 tahun 2016 tentang ITE, yaitu pada Pasal 27 ayat (1) jo Pasal 45 dalam ketentuan pasal ini dapat dikenakan pada pelaku prostitusi online karena telah mengakomodir sarana yang digunakan yaitu melalui media elektronik dan perbuatan tersebut melanggar kesusilaan.
